Analysis

This ordinance revises various provisions of the code for purposes of revising errors, clarifying language and eliminating obsolete provisions.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1.  Section 75-21-2-b-3 of the code is amended to read:

75-21.  Massage Establishment Regulations.

2.  MASSAGE ESTABLISHMENT.

b.  Content of Application.

b-3.  [[Three]]>>One<<[[one-]]>>two<< by [[one-]]>>two<< inch [[photographs]]>>photograph<< taken within 6 months of the date of the application.

 

Part 2.  Section 78-17-2 and 5 of the code is amended to read:

78-17.  Dog and Cat Licenses.

2.  APPLICATION.  Application for licenses shall be made to the [[city treasurer]]>>Milwaukee area domestic animal control commission<< and shall include the name and address of the applicant, description of the animal, the appropriate fee, whether the animal is spayed or neutered and a rabies certificate or tag issued by a licensed veterinarian illustrating that the animal for which the license is sought has received current immunization for rabies or a statement issued by a licensed veterinarian that the immunization for rabies is contraindicated for the animal . A rabies certificate or tag shall be deemed valid if the termination date of the immunization falls after the date of the application for the license. Written proof is required from a licensed veterinarian that the animal being licensed has been spayed or neutered in order to qualify for a reduced license fee.

5.  ISSUANCE.  Upon acceptance of the license application and fee, the [[city treasurer]]>>Milwaukee area domestic animal control commission<< shall issue a tag and a license.  The tag shall be securely attached by the licensee to a collar or harness and the collar or harness with the tag attached shall be kept on the dog or cat for which the license is issued at all times.  This requirement does not apply to a dog or cat securely confined indoors or in a fenced area.

 

Part 3.  Parts 17 and 39 of file number 070417, passed September 25, 2007, effective January 1, 2008, are repealed.

 

Part 4.  Section 101-5.5-4-b, c and d of the code is amended to read:

4.  MULTIPLE TRIP PERMIT.

b.  The multiple trip permit shall be effective for a period of one month or [[6]] >>12<< months.

c.  A fee shall be paid in accordance with s. [[81-80]] >>81-50.5<< prior to issuance of the permit.

d.  A multiple trip permit issued for [[6]] >>12<< months may be transferred within the same [[6]] >>12<< month period to another vehicle upon proper application to the commissioner of public works.  A fee shall be paid in accordance with s. [[81.80]] >>81-50.5<< to transfer the permit.

 

Part 5.  Section 109-17-4 of the code is amended to read:

109-17.  Complaint Procedure.

4.  The department of [[administration]] >>employee relations<< may employ such investigators and administrative law judges as it deems necessary to hear and decide complaints of discrimination and to assist in the administration of this chapter.  The administrative law judges may propose findings and orders under this chapter.

 

Part 6.  Sections 108-21 to 108-25 of the code are repealed.

 

Part 7.  Section 305-5 of the code is repealed.

 

Part 8.  Section 350-37-2-a-2 of the code is amended to read:

350-37.                     Sick and Disability Leave.

2.  ACCUMULATIVE BASIS.

a-2.  In addition to the normal sick leave which employees under this subsection are entitled to, public officials appointed pursuant to s. 62.51, Wis. Stats., and the director of administration and the director of employee relations [[and their deputies]]shall be credited with a special sick leave account of 30 sick leave days.  This special account shall be available for use until such time as 30 regular sick leave days have accrued in the normal sick leave account.  As normal sick leave account days accrue, the special sick leave account shall be reduced accordingly.  Unused days in such special sick leave accounts shall not be considered in the computation of any applicable benefits, including but not limited to pension benefits, retirement health insurance benefits, terminal leave benefits or sick leave incentive pay benefits.
