Title
Substitute resolution authorizing the transfer of up to $30,000 from the Common Council Contingent Fund to the Office of the City Attorney’s Claims and Damages fund to cover the cost of resolving certain claims recommended for settlement.
Analysis
Substitute resolution authorizing the transfer of $30,000 from the Common Council Contingent Fund to the City Attorney’s Office’s Damages and Claims Special Purpose Account for the purpose of paying allowed uninsured motorist claims as described in Common Council files 210325 and 210334.
Body
Whereas, on June 28, 2021, the Judiciary and Legislation Committee approved the City Attorney’s settlement of the uninsured motorist claims of Frank Heeg, as described in file 210325, for the amount of $7,000.00; and
Whereas, on June 28, 2021, the Judiciary and Legislation Committee approved the City Attorney’s settlement of the uninsured motorist claims of Taylor Baas, as described in file 210334, for the amount of $25,000.00; and
Whereas, in both files mentioned, the claimants are City of Milwaukee police officers who were involved in motor vehicle accidents with uninsured motorists while in the scope of their employment; and
Whereas, pursuant to Milwaukee Code of Ordinances 304-7, the City Attorney is authorized to settle motor vehicle liability claims; and
Whereas, the City is obligated to make those payments out of the City Attorney’s Damages and Claims Fund; and
Whereas, the City Attorney’s Damages and Claims Fund does not have sufficient funds to fully cover those settlements authorized by the Common Council; now therefore be it
Resolved, By the Common Council of the City of Milwaukee, that the City Comptroller is authorized to transfer up to $30,000.00 from the 2021Common Council Contingent Fund (0001-9990-0001-C001-006300), to the City Attorney’s 2021 Damages and Claims Fund (006300-0001-1490-0001-S118) and, be it
Further Resolved, that the proper City officers are authorized to make the necessary transfers to the appropriate accounts or funds to disburse the settlement amounts.
