Title

Substitute resolution authorizing a lease with the Federal Aviation Administration for an aviation marker near 2275 N. Lincoln Memorial Drive. 

 

Analysis

This resolution authorizes the proper City officials to enter into a new lease with the Federal Aviation Administration for an aviation marker for General Mitchell Field.  This marker is located on City property near 2275 N. Lincoln Memorial Drive.

 

Body

Whereas, The City of Milwaukee owns certain real estate located at 2275 N. Lincoln Memorial Drive in Milwaukee, Wisconsin which is the site of the Water Works’ North Point Pumping Station; and

 

Whereas, The City of Milwaukee and Federal Aviation Administration (FAA) had a lease which covered the period of October 1, 1995 through September 30, 2005, that described the terms and conditions upon which the FAA maintains an aviation marker for General Mitchell Field; and

 

Whereas, The FAA desires to continue with this installation and lease of the property from the City; and 

 

Whereas, The Department of Public Works, Water Works has been working with the City Attorney’s Office to draft and put in place a new lease with the FAA; and

 

Whereas, Both the City and the FAA desire to continue with the terms of the lease as a “no cost” lease in the spirit of intergovernmental cooperation; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Department of Pubic Works, Water Works and the City Attorney’s Office are authorized and directed to continue the preparation of a new lease document between the FAA and the City for the aviation marker; and, be it

 

Further Resolved, That the finalized lease document shall be substantially the same in form and substance as the lease agreement that is part of this file; and, be it

 

Further Resolved, That the Commissioner of Public Works and the Superintendent of Milwaukee Water Works are authorized and directed to enter into a new lease with the FAA, in accordance with this resolution, that will govern and control the City-FAA landlord-tenant relationship for the aviation marker site; and, be it

 

Further Resolved, That the City acts under Code of Ordinances Sec. 304-49-17, and finds that the non-monetary benefits to the City under the lease constitute adequate fair market consideration, and that the leasehold interest is surplus to City needs such that (subject to the City’s continuing rights in and to the property and under the lease), the City may lease the same to the FAA.
