Title
Resolution regarding the freeway noise barrier #18 proposed to be constructed along the Plainfield Curve of the west side of I-94 between West Howard Avenue to South 6th Street by the Wisconsin Department of Transportation. (Infrastructure Services Div.)
Analysis
This resolution indicates the City's support in principle for the construction of a freeway noise barrier (No. 18) along the west side of I-94 between West Howard Avenue to South 6th Street in the City of Milwaukee.  The noise barrier construction is to be undertaken at no cost to the City.  The City's support for construction of the freeway noise barrier is contingent upon the Common Council's approval of the barrier final design, appearance and location.
Body
Whereas, The Wisconsin Department of Transportation (WISDOT) has conducted a study identifying where traffic noise levels at properties located adjacent to freeways could be reduced with the construction of noise barriers; and
 
Whereas, A noise barrier located on the west side of I-94 between West Howard Avenue to South 6th Street was identified as one which would reduce noise levels for those properties located adjacent to said barrier; and
 
Whereas, Common Council Resolution File Number 900693, adopted September 4, 1990, authorized and directed the submittal of applications to the WISDOT for the programming for the construction of freeway noise barriers at those eligible locations in the City which, according to WISDOT criteria, could be constructed at no cost to the City; and
 
Whereas, The WISDOT criteria specifies that construction of any freeway noise barrier cannot be undertaken unless the local governmental agency submits the following:
 
1.  A resolution supporting the location and design of the proposed project.
 
2.  Documentation of land-use controls for the lands adjacent to the freeway;
 
and
 
Whereas, The WISDOT has held a public informational meeting to solicit comments on the construction of the freeway noise barrier and there was favorable support for noise barrier No. 18; and
 
Whereas, The City has existing land use and zoning ordinances for the lands adjacent to the freeway to comply with the intent of the WISDOT criteria regarding future development; and
 
Whereas, The City desires that the freeway noise barrier project proceed, however, the City is concerned about the design, appearance and location of the freeway noise barrier as these items are only in their preliminary stages; and
 
Whereas, The WISDOT has not to date provided final barrier design details;  now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that the City supports in principle the construction of a freeway noise barrier No. 18 at no cost to the City along the west side of I-94 between West Howard Avenue and South 6th Street; and, be it
 
Further Resolved, That the City's support for the construction of the freeway noise barrier is contingent upon approval of the freeway noise barrier final design, appearance and location by the Common Council upon submission of same by the WISDOT.
