Resolution authorizing the Commissioner of Public Works to execute Change Order 1 to the Green Solutions funding agreement with the Milwaukee Metropolitan Sewerage District for the installation of bioswales in the area around Jewell playfield at 1801 West Jewell Avenue, in the 13th Aldermanic District.
Analysis
This resolution authorizes the Department of Public Works, Infrastructure Services Division, to execute a $75,000 change order to the Milwaukee Metropolitan Sewerage District Green Solutions grant funding for the construction of bioswales with a revised maximum reimbursement amount of $257,000. The bioswales are constructed in the in the area around Jewell playfield at 1801 West Jewell Avenue. The change order is necessary because the cost of the project has increased more than what was originally funded by the grant.

Whereas, Common Council File No 221822 authorized the City to enter into an agreement (Green Solutions Funding Agreement G98005P121) with the Milwaukee Metropolitan Sewerage District (MMSD) to accept and fund a Green Solutions grant for the installation of bioswales in the area around Jewell playfield at 1801 West Jewell Avenue.; and
Whereas, Said File authorized expenditures of $182,000 in grantor share; and
Whereas, The total estimated construction cost of said bioswales around Jewell playfield is revised from $182,000 to $257,000 and can be funded in its entirety by grantor share; and
Whereas, MMSD has prepared Change Order 1 amending said agreement that it will provide a total of $257,000 in grantor funds; and
Whereas, Said change order will provide additional $75,000 in grantor funds; now, therefore, be it
Resolved, That the Commissioner of Public Works is authorized to accept and execute Change Order 1 to the MMSD Green Solutions grant agreement in accordance with Milwaukee Code of Ordinances 304-81, and to execute the change order in the form submitted to this file, or in substantial conformity thereto; and, be it
Further Resolved, That upon approval of the change order to said Agreement, the City Comptroller is authorized to create within the Capital Grant and Aid Projects Fund the appropriate Project/Grant Chartfield Value for this project, and transfer to these accounts the amount required under the agreement and City accounting policy, but not to exceed a ten percent increase of the total amounts reserved for the grantor’s share and local share or $5,000, whichever is greater, as follows:

Further Resolved, That these funds are appropriated to the Department of Public Works, which is authorized to expend from the amount budgeted for specific purposes as indicated in the grant budgets and incur costs consistent with the award date; and, be it
Further Resolved, That the Commissioner of Public Works shall have the authority to authorize transfers within the project budget so long as the amount expended for any purpose shall not exceed the amount authorized by the budget by 10% and such transfers are in accordance with grantor regulations; and, be it
Further Resolved, That the Commissioner of Public Works, on behalf of the City of Milwaukee, is authorized to enter into subcontracts (and leases) as detailed in the project budget and in accordance with City purchasing procedures and grant and aid guidelines for awarding such contracts.
