Resolution authorizing and directing the proper City Officers to execute an Out-of-Program Agreement between American Stores Properties, Inc. and the City of Milwaukee for construction of public improvements to support development of the approximately 13-acre vacant parcel located at the southeast corner of North Humboldt Boulevard and East North Avenue.

ANLS:

- ANALYSIS - This resolution approves an Out-of-Program Agreement between the City of Milwaukee and American Stores Properties, Inc., the proposed developer of vacant land located at the southeast corner of East North Avenue and North Humboldt Boulevard. The agreement describes the public improvements needed to support the proposed development and identifies the parties responsible for funding those improvements. In general, the developer will provide money up-front with the City refunding a portion of the deposited funds in the year following completion of the improvements.

BODY:

Whereas, American Stores Properties, Inc. plans to construct a commercial development consisting of a Jewel food store, an Osco drug store, and additional retail space at the southeast corner of East North Avenue and North Humboldt Boulevard (aka Humboldt Yards); and

Whereas, The development will require various public improvements including sewer and water extensions, as well as a new public street; and

Whereas, The developer now desires to enter into an Out-of-Program Agreement with the City of Milwaukee to provide for construction and funding of the required public improvements; and

Whereas, The Out-of-Program Agreement for this project is attached to this file; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee that the Out-of-Program Agreement attached to the file is hereby approved and the proper City Officials are hereby authorized and directed to execute said agreement on behalf of the City; and, be it

Further Resolved, That the Commissioner of Public Works is authorized to make minor, non-substantive changes to the Out-of-Program Agreement prior to its execution.
