Analysis
This ordinance increases from one to at least 2 the number of video surveillance cameras required for convenience food stores, and requires at least one camera surveils the counter and register while at least one other camera surveils the faces of patrons entering and leaving the store. The ordinance also specifies video images are to be date and time-stamped when recorded and be retrievable. Furthermore, the ordinance sets technical requirements for how video recordings are stored and provided to the licensing committee and the police.
 
Body
Whereas, The video quality of camera surveillance systems mandated by current code provisions for convenience stores does not fully meet the needs of investigators working to solve crimes or the evidentiary needs of prosecutors in court; and
 
Whereas, Newer video technology does more closely meet the needs of investigators working to solve crimes and the evidentiary needs of prosecutors in court; and
 
Whereas, The cost of installing the more useful, 4-camera video surveillance system mandated by this ordinance is $400 to $1,000 more than 2-camera systems widely used by convenience stores to comply with current code requirements; and
 
Whereas, The use of the newer video technology mandated by this ordinance is expected to facilitate the investigation of convenience store holdups, provide more compelling evidence for prosecutors to use in court and reduce convenience store crime; now, therefore
 
 
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
 
Part 1. Section 68-4.3-1-a and b of the code is renumbered 68-4.3-1-d and h.
 
Part 2. Section 68-4.3-1-a to c and e to g of the code is created to read:
68-4.3. Convenience Food Stores.
1. DEFINITIONS.
a. "CCDTV" means a closed circuit digital television system.
b. "CD" means a compact disc suitable for recording digital video images.
c. "CD-R" means a compact disc suitable for recording digital video images that cannot be altered or erased once recorded.
e. "DVD" means a digital video disc suitable for recording digital video images.
f. "DVD-R" means a digital video disc suitable for recording digital video images that cannot be altered or erased once recorded.
g. "Media" means CD's, DVD's, CD-R's, DVD-R's, computer hard drives or any materials used to record or store digital video images, text, graphics and audio data.
 
Part 3. Section 68-4.3-2-e-0 of the code is repealed and recreated to read:
2. REGULATIONS.
e. Install, maintain in proper working order and operate during all hours the store is open to customers at least 2 high resolution surveillance security cameras which can produce reproducible digital color images from a digital video recorder. Each camera shall display a date and time stamp on each image, and produce retrievable images suitable for permanent police records. Digital video recording equipment shall be maintained in proper working order at all times during store operating hours. Additional cameras shall be installed as needed to record views and images stipulated in sub. 1. The police may encourage convenience stores to position and use cameras in addition to the 2 required by this section to bolster overall crime prevention efforts.
 
Part 4. Section 68-4.3-e-1 and 3 of the code is repealed and recreated to read:
e-1. At least one camera shall provide an overall view of the counter and register area, and at least one camera shall be positioned to provide a clear, identifiable, full-frame image of the face of each person entering and leaving the store. Camera views shall not be obstructed by store fixtures or displays.
 
e-3. All digital video records shall be stored on CD-R's or DVD-R's and maintained in good viewing order for 30 days after recording, and made available upon request to the licensing committee and law enforcement officers. Digital video recordings shall be date and time stamped, and all CD-R's and DVD-R's used to store video recordings shall be marked with the date the media was recorded. At least one blank CD-R or DVD-R per camera shall be available during all hours the store is open to customers to replace CD-R's or DVD-R's provided to the licensing committee or law enforcement officers, or to replace video recording media that fail.
 
Part 5. Section 68-4.3-2-e-4 of the code is renumbered 68-4.3-2-e-5.
 
Part 6. Section 68-4.3-e-4 of the code is created to read:
e-4. CCDTV systems must be capable of copying all images to CD-R's or DVD-R's while maintaining the native format. Digital video recordings recorded by CCDTV systems on CD's or DVD's shall to copied onto CD-R's or DVD-R's whenever the system's video recording media reaches capacity, but not less frequently than once every 30 days. All CCDTV system recorded images requested by the licensing committee and law enforcement officers shall be provided on CD-R's or DVD-R's. CCDTV playback software needed to view recorded images shalll be copied onto each CD-R or DVD-R used to store CCDTV recorded video images.
 
Part 7. This ordinance takes effect June 30, 2011.
