Resolution relative to application, acceptance and funding of a 2013 Urban Non Point Source & Storm Water Management Program Grant for the installation of bioswales on East Greenfield Avenue between the Chicago & North Western Railway right of way and the Kinnickinnic River and authorizing the City Engineer to execute and execute a Grant Award Agreement between the City of Milwaukee and the Wisconsin Department of Natural Resources.
Analysis
This resolution authorizes the Department of Public Works, Infrastructure Services Division to apply, accept and fund a Wisconsin Department of Natural Resources (DNR) Urban Nonpoint Source and Storm Water Management Program (UNPS&SW) Grant in the amount of $180,000 with a City of Milwaukee (City) share of $90,000 and a grantor share of $90,000. The purpose of the grant is to install facilities known as bioswales to help reduce stormwater pollution in the terrace areas of the East Greenfield Avenue between the Chicago & North Western Railway (C&NW) right of way and the Kinnickinnic River. This resolution also authorizes and directs the City Engineer to execute a UNPS&SW Grant Award Agreement between the City and the DNR.

Whereas, Stormwater pollution control is an important component of the City'S storm water management regulation and the City's stormwater discharge permit with the DNR; and
Whereas, Nonpoint source pollutants such as roadways have been recognized as a major environmental pollutant in the country; and
Whereas, Pollution from public streets discharges directly into streams and water bodies during storm events, threatening natural habitat and species; and
Whereas, This project will incorporate bioswales, which are an established and cost effective means of removing polluted sediment from public streets; and
Whereas, The City is has applied for UNPS&SW grant funds from the DNR for the installation of bioswales in the terrace areas of the East Greenfield Avenue right of way between the C&NW right of way and the Kinnickinnic River; and
Whereas, The DNR has accepted the City's application and has awarded the City with matching grant funds; and
Whereas, The bioswales will be constructed as part of an overall street reconstruction project of East Greenfield Avenue from South First Street to the Kinnickinnic River; and
Whereas, The operation of the grant is from January, 2013 through December, 2014 and is estimated to cost $180,000, of which $90,000 (50%) would be provided by the City and $90,000 (50%) would be provided by the DNR; and
Whereas, Department of Public Works has committed funds for the entire cost of the project (SM493130103) per common council file Number 121679; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the City Engineer is hereby authorized to accept and execute such a grant without further Common Council approval unless the terms of the grant change as indicated in Common Council file 030712 (Grant Ordinance); and, be it
Further Resolved, That upon approval of this Agreement, the City Comptroller is hereby authorized to create within the Capital Grant and Aid Projects Fund the appropriate Project/Grant Chartfield Value for this project; and transfer to these accounts the amount required under the agreement and City accounting policy, but not to exceed a ten percent increase of the total amounts reserved for the grantor's share and local share or $5,000, whichever is greater as follows:

Further Resolved, That these funds are appropriated to the Department of Public Works, which is authorized to expend from the amount budgeted for specific purposes as indicated in the grant budgets and incur costs consistent with the award date; and, be it
Further Resolved, That the City Engineer is authorized to accept and execute a Grant Award Agreement between the City and the DNR regarding said grant; and, be it
Further Resolved, That the City Engineer shall have the authority to authorize transfers within the project budget so long as the amount expended for any purpose shall not exceed the amount authorized by the budget by 10% and such transfers are in accordance with grantor regulations; and, be it
Further Resolved, That the City Enginner on behalf of the City of Milwaukee be authorized to enter into subcontracts (and leases) as detailed in the project budget and in accordance with City purchasing procedures and grant and aid guidelines for awarding such contracts.
