Title

Resolution authorizing and directing the Commissioner of Public Works to execute a revised project agreement title “Revised State/Municipal Agreement for a Highway Improvement Project” with the Wisconsin Department of Transportation to include updated construction costs for the reconstruction of East North Avenue between North Booth Street and North Bremen Street with Federal/State aid under the Hazard Elimination Safety Program.  (Infrastructure Services Division)

Analysis

This resolution authorizes and directs the Commissioner of Public Works to execute a revised project agreement with the Wisconsin Department of Transportation (WISDOT) for a revised federal cap on construction costs.  This resolution increases the federal cap on the construction phase of this project by moving the Hazard Elimination Safety (HES) funds previously slotted for real estate to the construction phase.  This revised agreement will increase federal participation for construction from $400,000 to $470,400, ten percent of which is City of Milwaukee costs.

Body

Whereas, Common Council Resolution File Number 040032, adopted on June 15, 2004, authorized and directed the Commissioner of Public works to execute a project agreement with Wisconsin Department of Transportation (WISDOT) for the programming and construction of East North Avenue between North Booth Street and North Bremen Street with Federal/State aid under the Hazard Elimination Safety Program; and

 

Whereas, Preliminary engineering activities have begun and the only properties affected by the new roadway geometrics are city-owned parkland; and

 

Whereas, No real estate acquisition from outside entities is necessary for this project; and

 

Whereas, Construction costs for this Federal/State aid project were capped; and

 

Whereas, Preliminary construction cost estimates exceeded the federal cap; and

 

Whereas, The City of Milwaukee requested and the WISDOT agreed to transfer the federal monies slotted for real estate acquisition to the construction phase of the project; and

 

Whereas, The revised project agreement with the updated construction costs and federal caps has been received from the WISDOT to be executed by the City of Milwaukee for the design and construction of East North Avenue from North Booth Street to North Bremen Street with Federal/State aid under the Hazard Elimination and Safety Program; and

 

Whereas, Construction funds for the project will be included in future resolutions; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby authorized and directed to execute the revised project agreement for the design and construction of East North Avenue from North Booth Street to North Bremen Street with Federal and State aid under the Hazard Elimination and Safety Program, copies of which are attached to Common Council Resolution File Number 050978, and are incorporated by reference as though set forth in full; and, be it

 

Further Resolved, That the City Engineer is hereby authorized and directed to approve and make periodic payments to the WISDOT upon receipt of invoices for the City of Milwaukee’s share of the costs of the project.
