Adoption of this resolution by at least two-thirds vote of the Common Council of the City of Milwaukee will approve the blight designation of the City-owned property at 1676 South 14th Street, declare the property surplus, direct the conveyance of the property to the Redevelopment Authority for disposition, and authorize the Redevelopment Authority to convey the property according to the conditions referred to in the Land Disposition Report.
BODY:
Whereas, In Common Council File No. 49-2311-8d, adopted on September 16, 1968, the Redevelopment Authority of the City of Milwaukee ("Authority") was designated the Agent of the City of Milwaukee ("City") for the purpose of administering, undertaking, and carrying out all blight elimination, slum clearance, and urban renewal programs and projects both present and future; and
 
Whereas, Applicable Wisconsin law, particularly Section 66.431(5)(c), Wisconsin Statutes, as amended, enables the Authority of a first class city, with the approval of the local legislative body of that city, to acquire blighted property without designating a boundary or adopting a redevelopment plan; and
 
Whereas, The Authority desires to acquire the City-owned property in the general area of South 14th Street and West Historic Mitchell Street, more particularly described as 1676 South 14th Street (Tax Key No. 460-0102-000-5) for the purpose of eliminating blight; and
 
Whereas, The Commissioner of the Department of Public Works has informed the Authority that the property is no longer needed for public parking purposes and is surplus to municipal needs conditioned upon the property being sold for market value by the Authority for redevelopment and returning the sales proceeds to the Department of Public Works; and
 
Whereas, The City waived its right to receive the statutory notices and the Authority conducted a Public Hearing on July 10, 1997 pursuant to the provisions of Section 66.431(5)(c), Wisconsin Statutes, as amended; and
 
Whereas, The Authority determined the subject property to be blighted within the meaning of Section 66.431(4)(bm), Wisconsin Statutes, as amended, and requested Common Council of the City of Milwaukee ("Council") approval of this Spot Acquisition Project identified as 1676 South 14th Street (Tax Key No. 460- 0102-000-5) as evidenced by adoption of a Resolution of said Authority; and
 
Whereas, In relation to the location and extent of public works and utilities, public buildings, and public uses proposed, the Authority has conferred with the City Plan Commission and with such other public officials, boards, authorities, and agencies of the City under whose administrative jurisdictions such uses respectively fall pursuant to Subsection 66.431(6)(c), Wisconsin Statutes; and
 
Whereas, The City Plan Commission, which is the duly designated and acting official planning body for the City authorized to prepare a comprehensive plan, has reviewed and determined that this Spot Acquisition Project conforms to the general plan for the City as a whole, and the Council has duly considered the recommendations of the planning body; and
 
Whereas, The City Plan Commission has also determined that the subject property has no possible municipal use and is surplus to the City's needs; and
 
Whereas, After acquisition, the Authority desires to convey the subject property to Capital Ventures, L.L.C. for retail development; and
 
Whereas, Pursuant to Section 66.431, Paragraph 9, Wisconsin Statutes, a Land Disposition Report for this property was submitted; and
 
Whereas, The Public Hearing conducted on July 10, 1997, concurrently addressed the disposition of this property as required by Wisconsin Statutes; and
 
Whereas, Prior to the transfer or sale of this property, an exemption would be required from the provision of Common Council File No. 920379, which placed a moratorium on the purchase, sale or construction of any new or existing City and Authority parking facilities until a Citywide Transportation Plan is adopted by the Council; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that the Spot Acquisition Project known as 1676 South 14th Street, further identified as Lots 8 and 9, Block 1, Burnham, Rogers & Becher's Subdivision of the East 1/2 of the Northeast 1/4 and the Southeast 1/4 of Section 6, Township 6 North, Range 22 East, as shown on the map attached to this Common Council File, is approved; and, be it
 
Further Resolved, That it is found, determined, and reaffirmed that:
 
1. This Spot Acquisition Project is a blighted property in need of blight elimination, slum clearance, and urban renewal, and qualifies as an eligible Project within the meaning of Section 66.431(4)(bm), Wisconsin Statutes, as amended.
 
2. The objectives of the Authority cannot be achieved solely through rehabilitation of the Project.
 
3. This Spot Acquisition Project is feasible and conforms to the general plan of the City; and, be it
 
Further Resolved, To implement and facilitate the prosecution of this Spot Acquisition Project, certain official action to support the new land uses after redevelopment may be taken with general references, among other things, to changes in zoning; the vacation and removal of streets, alleys, and other public ways; the location and relocation of sewer and water mains and other public facilities; and other public actions deemed necessary to effectuate the purpose of this Project including the prohibition of any new construction in the Project area, and accordingly, the Council:
 
1. Pledges its cooperation in helping to carry out this Spot Acquisition Project.
 
2. Directs that no new construction shall be permitted or authorized in this Project by any agencies, boards, or commissions of the City under local codes or ordinances unless as authorized by the Council under Section 66.431(6)(e), Wisconsin Statutes.
 
3. Directs the various public officials, departments, boards, and agencies of the City having administrative responsibilities in the premises likewise to cooperate to such end and to exercise their respective functions and powers in a manner consistent with this Project's objectives.
 
4. Stands ready to consider and take appropriate action upon proposals and measures designed to effectuate this Project; and, be it
 
Further Resolved, That the City Clerk is authorized and directed to transmit a certified copy of this resolution to the Commissioner of the Department of Public Works, the Commissioner of Building Inspection, the City Engineer, the Assessment Commissioner and the Redevelopment Authority of the City of Milwaukee, and to such other agencies, boards, and commissions of the City having administrative jurisdiction in the premises described above; and, be it
 
Further Resolved, That the property is declared surplus and that the proper City officials are authorized and directed to execute a quit claim deed and any other related document(s) deemed necessary to effectuate the transfer of title to the subject property from the City to the Authority without monetary consideration at such time as the Authority is to reconvey the property for development; and, be it
 
Further Resolved, That this property is exempt from the moratorium on the purchase, sale or construction of any new or existing City and Authority parking facilities required by Common Council File No. 920379; and, be it
 
Further Resolved, That the Land Disposition Report dated July 10, 1997, with respect to the proposed conveyance of the following property, is approved:

Further Resolved, That upon sale of the property by the Authority, the net sale proceeds shall be returned to the Department of Public Works and deposited in Account No. 45-661-9950; and, be it
 
Further Resolved, That inasmuch as the proposed redevelopment project contemplates the future vacation of an alley separating the parcels to be assembled, the Commissioner of the Department of City Development is authorized to sign a vacation petition on behalf of the City, as adjoining property owner, should application for same be initiated by the developer; and, be it
 
Further Resolved, That should the developer require building permits and permission to begin construction on the alley proposed to be vacated in the future, the Commissioner of the Department of Public Works is authorized to enter into a written agreement with the developer providing for the same, contingent upon the developer (1) having initiated the alley vacation process, (2) agreeing to assume all liability for use and occupancy of the site, and (3) agreeing to remove any and all improvements that may be constructed and to restore the alley to the condition existing prior to construction, in the event the vacation is not approved.
