Analysis

This ordinance amends the code’s present provisions regarding the control of noxious weeds.  It also defines turf grasses.  Presently, the provisions apply to specific species of grasses and weeds.  Under this ordinance, the regulations apply to all noxious grasses and weeds.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1.  Section 80-17-1 to 4 of the code is renumbered 80-17-2 to 5.

 

Part 2.  Section 80-17-1 of the code is created to read:

 

1. DEFINITION.  In this section, “turf grass” means annual bluegrass, annual ryegrass, bahiagrass, bermudagrass, buffalograss, carpetgrass, centipedegrass, colonial bentgrass, creeping bentgrass, fine fescue, hybrid bermudagrass, kentucky bluegrass, kikuyugrass, orchardgrass, perennial ryegrass, quackgrass, rough bluegrass, seashore paspalum, St. Augustinegrass, tall fescue and zoysiagrass.

 

Part 3.  Section 80-17-2 of the code is amended to read:

 

80-17. Hay Fever Weeds, etc.

2.  TO BE CUT.  It shall be unlawful to permit within the city the pollenization of any >>turf<< grasses or weeds which cause or produce hay fever in human beings. In order to prevent such pollenization, [[none of the following grasses, and]] no >>turf grass or<< weeds of any kind shall be permitted to grow or stand more than 9 inches on any property in the city [[, to-wit: Meadow grass (poa annua), bull grass (paspalum vasyanum), Bermuda grass (capriola dactylon), smut grass (sporabulus augustus), Johnson grass (andropogen halapense), feather grass (leptochloa filformis), foxtail grass (chaetochloa glauca) and cockspur grass (panicum crus-galli)]].
