Resolution authorizing the Commissioner of Public Works to execute an Agreement between the City of Milwaukee and Milwaukee County for the maintenance of bioswales in the medians of West Good Hope Road (CTH PP) between North 97th Street and North Granville Road, in the 5th Aldermanic District.
Analysis
This resolution authorizes the Commissioner of Public Works to execute a document titled an Agreement for Maintenance or other Roadside Landscaping within Milwaukee County Trunk Highway (CTH) Right of Way - Agreement No. 2018PP1 between the City of Milwaukee and Milwaukee County for the maintenance of four bioswales. The bioswales are located in the medians of West Good Hope Road (CTH PP) between North 97th Street and North Granville Road, in the 5th Aldermanic District.
Body
Whereas, Stormwater pollution control is an important component of the City of Milwaukee’s (City) storm water management regulations and the City’s stormwater permit with the Wisconsin Department of Natural Resources (DNR); and
Whereas, Nonpoint sources such as roadways have been recognized as the primary source of environmental pollution by discharging polluted runoff directly into the local streams and water bodies, threatening natural habitat and species; and
Whereas, The City proposes to construct sixteen bioswales in the medians of West Good Hope Road (CTH PP) between North 97th Street and North Granville Road, which is under the jurisdiction of the Milwaukee County (County); and
Whereas, In order to establish the terms and conditions for the maintenance and ownership of the bioswales, the City and the County desire to enter into an Agreement, attached, hereto; and
Whereas, The County has prepared the titled an Agreement for Maintenance or other Roadside Landscaping within Milwaukee County Trunk Highway (CTH) Right of Way - Agreement No 2018PP1; and
Whereas; Said agreement stipulates that the City will retain ownership of the bioswales and of the associated facilities and shall also receive the total amount of the Total Suspended Solids (TSS) reduction credits; and
Whereas, The Agreement also outlines that the City will maintain the bioswales including the vegetation and all associated facilities in good condition to ensure proper functionality, now, therefore, be it;
Resolved, That the Commissioner of Public Works is authorized to execute said Agreement No. 2018S1 between the City and the County regarding the maintenance of the bioswales in the medians of West Good Hope Road (CTH PP) between North 97th Street and North Granville Road, said Agreement being attached to this Common Council File and incorporated in this resolution by reference as though set forth in full.
