Title

Substitute resolution to facilitate the remediation and development of the City-owned brownfield at 1200 West Washington Street by approving the blight designation and acquisition by the Redevelopment Authority and authorizing subsequent conveyance to MCC Youthbuild, LLC, in the 12th Aldermanic District.

Analysis

Adoption of this substitute resolution by at least two-thirds vote of the Common Council will approve the blight designation and acquisition of a property by the Redevelopment Authority and will authorize its subsequent conveyance to a third party for redevelopment according to the conditions in a Blight Designation Summary and Land Disposition Report.

Body

Whereas, The Redevelopment Authority of the City of Milwaukee (“Authority”) applied for funding from the Wisconsin Department of Natural Resources (“WDNR”) 2009 Recovery Act Ready for Re-Use Program to remediate the City-owned brownfield at 1200 West Washington Street that was acquired by the City through In-Rem foreclosure; and

 

Whereas, WDNR requires that the Authority own the brownfield as a condition of accepting and using the remediation grant; and

 

Whereas, Section 66.1333(5)(c), Wisconsin Statutes, enables the Authority, with the approval of the Common Council of the City of Milwaukee (“Common Council”), to acquire blighted property without designating a boundary or adopting a redevelopment plan; and

 

Whereas, The City of Milwaukee (“City”) waived its right to the statutory notice and a public hearing was conducted on July 14, 2009 by the Authority pursuant to Section 66.1333(5)(c), Wisconsin Statutes; and

 

Whereas, After the hearing, the Authority determined the property to be blighted within the meaning of Section 66.1333(2m)(bm), Wisconsin Statutes, as outlined in a Blight Designation Summary and Land Disposition Report, a copy of which is attached to this Common Council File, and requested approval of this acquisition by the Common Council; and

 

Whereas, Upon the acquisition and successful remediation of the property, MCC Youthbuild, LLC desires to acquire the property and construct a single-family home that will be sold to an owner-occupant as summarized in the Blight Designation Summary and Land Disposition Report; and

 

Whereas, The public hearing that was conducted on July 14, 2009 concurrently addressed the disposition of the property as required by Wisconsin Statutes; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that it is found, determined and reaffirmed that:

 

1. The City-owned brownfield lot at 1200 West Washington Street is blighted within the meaning of Section 66.1333(2m)(bm), Wisconsin Statutes.

 

2. The objectives of the Authority cannot be achieved solely through rehabilitation of this property.

 

3. This acquisition is feasible and conforms to the general plan of the City; and, be it

 

Further Resolved, That to facilitate the acquisition, certain official action to support the new land uses after redevelopment may be taken with general references, among other things, to changes in zoning; the vacation and removal of streets, alleys and other public ways; the location and relocation of sewer and water mains and other public facilities; and other public actions deemed necessary to effectuate the purpose of the acquisition including the prohibition of any new construction at the property, and accordingly, the Common Council hereby:

 

1. Pledges its cooperation in helping to carry out this acquisition.

 

2. Directs that no new construction shall be permitted or authorized at this property by any agencies, boards or commissions of the City under local codes or ordinances unless as authorized by the Common Council under Section 66.1333(6)(e), Wisconsin Statutes.

 

3. Directs the various public officials, departments, boards and agencies of the City having administrative responsibilities in the premises likewise to cooperate to such end and to exercise their respective functions and powers in a manner consistent with the objectives for this acquisition.

 

4. Stands ready to consider and take appropriate action upon proposals and measures designed to effectuate this acquisition; and, be it

 

Further Resolved, That the Commissioner of the Department of City Development (“DCD”), or designee, is authorized to execute a deed to convey the City-owned brownfield to the Authority for no monetary consideration; and, be it

 

Further Resolved, That if the property is encumbered by any City deed restrictions that prohibited construction, required use as green space or were prohibited from division and/or combination, the Commissioner of DCD, or designee, is authorized to execute Release of Deed Restrictions so that clear title may be granted to the Redeveloper; and, be it

 

Further Resolved, That the Blight Designation Summary and Land Disposition Report dated July 14, 2009, with respect to the proposed conveyance of the property to MCC Youthbuild, LLC, is approved; and, be it

 

Further Resolved, That the City Clerk is directed to transmit a certified copy of this resolution to the Commissioner of the Department of Public Works, the Commissioner of the Department of Neighborhood Services, the City Engineer, the Assessment Commissioner, the Redevelopment Authority of the City of Milwaukee and to such other agencies, boards and commissions of the City having administrative jurisdiction in the property described above; and, be it

 

Further Resolved, That the net sale proceeds, less sale expenses and a 30 percent expense reimbursement to the Redevelopment Authority of the City of Milwaukee, shall be deposited in the Reserve For Tax Deficit Fund.
