Title
Resolution authorizing the proper City officials to accept disbursements of settlement payments relating to the National Prescription Opiate multidistrict litigation.
Analysis
This resolution authorizes the proper City officials to accept settlement funds received from all settling defendants in the settlement of the National Prescription Opiate multidistrict litigation in the United States District Court for the Northern District of Ohio Eastern Division, case no. 20-op-45044-DAP. The proper City officials are authorized to accept an initial settlement payment of up to $2,000,000, and to accept future settlement disbursements arising from the same litigation of up to $18,000,000 in aggregate, into a segregated account.

Whereas, On January 29, 2020, the City joined the National Prescription Opiate multidistrict litigation; and
Whereas, On March 22, 2022, the Common Council adopted Resolution File Number 211799, relating to settlement funds received from opioid litigation, which resolved that settlement funds received in this litigation shall be used to fund the Milwaukee Overdose Response Initiative and other harm-reduction strategies; and
Whereas, Nationwide settlements have been reached to resolve all opioid litigation brought by states and local political subdivisions against the three largest pharmaceutical distributors and a manufacturer and its parent company; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that, in relation to the City’s involvement in the National Prescription Opiate multidistrict litigation in the United States District Court for the Northern District of Ohio Eastern Division, case no. 20-op-45044-DAP, the proper City officials are authorized to accept an initial settlement payment of up to $2,000,000, and to accept future settlement disbursements arising from the same litigation of up to $18,000,000 in aggregate, into a segregated account; and, be it
Further Resolved, That the City Comptroller is authorized to create the necessary accounts to carry out the intent of the file; and, be it
Further Resolved, That no appropriation or expenditure of settlement funds received under this resolution shall be permitted unless authorized in a subsequent resolution.
