Title

Resolution authorizing the issuance of a permit to Kelley Construction allowing occupancy of the entire right-of-way of West Florida Street from South 5th Street for a distance of approximately 214 feet west to the dead end and also allowing occupancy of two-thirds of South 5th Street from West Florida Street for a distance of approximately 128 feet to the dead end.

Analysis

This resolution authorizes City officials to issue an occupancy permit to Kelley Construction allowing the company to close West Florida Street west of South 5th Street and South 5th Street north of West Florida Street.  Kelley is constructing the Iron Horse Hotel to be located at the northwest corner of West Florida Street and South 5th Street.  The project consists of rehabilitating an existing structure, which covers the entire site.  No on-site land is available for materials storage, staging, or construction management and project marketing activities.  Therefore, Kelley has requested permission to occupy the entire West Florida Street right-of-way from South 5th Street for a distance of approximately 214 feet west to the dead end and also allowing occupancy of two-thirds of South 5th Street from West Florida Street for a distance of approximately 128 feet to the dead end.  Occupancy is expected to last for about 10 months.

Body

Whereas, Kelley Construction is acting as the general contractor for the Iron Horse Hotel located at the northwest corner of West Florida Street and South 5th Street; and

 

Whereas, The Iron Horse Hotel Project consists of rehabilitating an existing building located on the site; and

 

Whereas, The existing building essentially covers the entire site leaving no room for materials storage, staging, and construction management/project marketing activities; and

 

Whereas, Kelley has requested permission to occupy all of West Florida Street right-of-way from South 5th Street for a distance of approximately 214 feet west to the dead end and two-thirds of the road right-of-way of South 5th Street from West Florida Street for a distance of approximately 128 feet to the dead end to provide for these functions; and

 

Whereas, The street closure is expected to last about 10 months; and

 

Whereas, Kelley has notified the property owner on the east side of South 5th Street of its plans to close the street; and

 

Whereas, The Commissioner of Public Works may approve temporary occupancy of up to one-third of public rights-of-way while temporary use beyond that point must be approved by the Common Council; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the appropriate City officials are hereby authorized to issue a permit to Kelley Construction allowing occupancy of the section of West Florida Street and South 5th Street described herein for a period of up to 10 months from the date the permit is issued.
