Title
Substitute resolution granting permission to Milwaukee County to install a granite monument sign, to be placed on City public right-of-way above North 9th Street, adjacent to the east elevation of the Milwaukee County Courthouse, in the 4th Aldermanic District of the City of Milwaukee.
Analysis
This resolution grants authority to the Commissioner of Public Works to issue a permit to install a granite monument sign, to be placed on City public right-of-way above North 9th Street, near the east elevation of the Milwaukee County Courthouse.  The sign will serve to identify a portion of the lands adjacent to the Courthouse as India-America Friendship Park.
Body
Whereas, The Milwaukee County Board of Supervisors adopted resolution number 01-531 on November 1, 2001, accepting a donation of a bronze statue of Mahatma Gandhi from the Wisconsin Coalition of Asian Indian Organizations; and
 
Whereas, The statue has subsequently been erected on Milwaukee County Property; and
 
Whereas, The Milwaukee County Board of Supervisors adopted resolution number 03-232 on April 17, 2003, designating a portion of the Courthouse plaza surrounding the statue as the India-America Friendship Park; and
 
Whereas, Milwaukee County has agreed to accept from the Wisconsin Coalition of Asian Indian Organizations a granite monument sign identifying the lands surrounding the statue as Indian-America Friendship Park; and
 
Whereas, Milwaukee County wishes to install the sign on the Courthouse plaza within the North 9th Street right-of-way; and
 
Whereas, The sign can only be permitted to occupy the public right-of-way, as proposed, by permission of the Common Council of the City of Milwaukee; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works of the City of Milwaukee is hereby authorized and directed to issue a permit to Milwaukee County or its agents for placement and maintenance of a granite monument sign on the Courthouse plaza within the North 9th Street right-of-way; and, be it
 
Further Resolved, That this permission is granted only on condition that Milwaukee County shall:
 
1.  Hold the City of Milwaukee or its agents harmless and accept full responsibility for any and all liability that may arise through implementation of the permission granted herein.
 
2.  Undertake the installation and continued maintenance of the sign at no cost to the City of Milwaukee.
 
3.  Obtain the necessary City permits for this construction prior to construction.
 
4.  Maintain the permitted item in a condition satisfactory to the Commissioners of Public Works and Neighborhood Services.
 
5.  Whenever the above-mentioned item is no longer needed or when so ordered for public necessity, not only remove the items but also restore to its former condition and to the approval of the Commissioner of Public Works any curb, pavement, or other public improvement which was removed, changed, or disturbed by reason of the granting of this permissory resolution.  Such grantee shall not be entitled to any damages for such removal.
