Title
Substitute resolution directing the City Comptroller to transfer $25,000 into the previously established preliminary engineering accounts for the Kinnickinnic River Bicycle Trail project. This project is funded 80 percent by Federal Congestion Mitigation and Air Quality Funds and 20 percent by City funds. This resolution will increase the preliminary engineering by $25,000 ($20,000 Congestion Mitigation and Air Quality Funds and $5,000 City), bringing the total preliminary engineering for this project up to $224,000 ($179,200 Congestion Mitigation and Air Quality Funds and $44,800 City.)
Analysis
Common Council Resolution Number 000019, adopted May 19, 2000 directed the Commissioner of Public Works to enter into a Project Agreement with the Wisconsin Department of Transportation and directed the City Comptroller to establish accounts for preliminary engineering for the Kinnickinnic River Bicycle Trail project. This project is funded 80 percent by Federal Congestion Mitigation and Air Quality Funds (CMAQ) and 20 percent by City of Milwaukee funds. The Common Council subsequently adopted Resolution Numbers 040623, 041290, and 051365, which established funding for preliminary engineering totaling $199,000 ($159,200 CMAQ and $39,800 City funds) This resolution transfers an additional $25,000 ($20,000 CMAQ and $5,000 City) into the preliminary engineering accounts to cover a shortfall in funds to finalize the plans for the bridge over South Chase Avenue.

Whereas, The City of Milwaukee Department of Public Works previously obtained a Congestion Mitigation and Air Quality (CMAQ) grant for the design, land acquisition, and construction of the Kinnickinnic River Bicycle Trail over the abandoned Union Pacific Railroad corridor between South 6th Street at West Rosedale Avenue and East Washington Street; and
Whereas, The CMAQ grant pays 80 percent of the project costs ($2,080,000) with the City paying 20 percent ($520,000), making a total estimated project costs of $2,600.00, including preliminary engineering, land acquisition, and construction; and
Whereas, The Common Council of the City of Milwaukee previously adopted Resolution File Numbers 000019, 040623, 041290, and 051365 which established funding for preliminary engineering for the Kinnickinnic River Bicycle Trail project totaling $199,000 ($159,200 CMAQ and $39,800 City); and
Whereas, The Common Council previously adopted Resolution File Number 010473 which established accounts for land acquisition totaling $1,095,000 ($875,000 CMAQ and $220,000 City); and
Whereas, Additional funds are needed to finalize the plans for the proposed bridge over South Chase Avenue; and
Whereas The CMAQ grant allows the City to transfer construction funds and land acquisition funds to the preliminary engineering accounts; and
Whereas, The land acquisition expenditures to date are $661,827 ($529,462 CMAQ and $132,365 City) with minimal additional land acquisitions expenditures anticipated; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the City Comptroller is directed to transfer into previously established preliminary engineering accounts for the Kinnickinnic River Bicycle Trail project the following amounts:

Further Resolved, That the City Comptroller is hereby authorized and directed to transfer additional amounts to the project grant values the amount required under the grant agreement and City accounting policy, but not to exceed a 10 percent increase of the total amounts reserved for the grantor's share and local share or $5,000, whichever is greater.
