Substitute resolution granting additional permission to the Milwaukee Metropolitan Sewerage District to place and maintain a river stage monitoring devices under and attached to the West Hampton Avenue bridge, east of North 32nd Street, in the 1st Aldermanic District in the City of Milwaukee.

- Analysis -
This resolution authorizes and directs the Commissioner of Public Works to now issue all necessary permits to the Milwaukee Metropolitan Sewerage District for the installation of conduits attached to the underside of the North Hampton Avenue Bridge, east of North 32nd Street, as well as continue to have permission for ultrasonic level sensor devices to be placed at the bottom of the east end of said bridges approximately 6 inches below the girder. The conduits will enable electricity as well as some monitoring equipment to connect from that control building east of the bridge to equipment west and north of the bridge.

BODY:
Whereas, The Milwaukee Metropolitan Sewerage District (MMSD) wishes to attach conduits to the underside of the North Hampton Avenue Bridge, east of North 32nd Street; and
Whereas, MMSD was previously granted permission to attach an ultrasonic level sensor device that is attached to the bottom of the east end of the same bridge, to enable MMSD to monitor the level of the Lincoln Creek; and
Whereas, The proposed conduits and the previously allowed devices may only occupy the public right-of-way with Common Council approval; now, therefore, be it
Resolved, That Common Council 930201, is hereby rescinded; and, be it
Further Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby authorized and directed to issue all necessary respective permits for attachment of the conduits to the bottom of the North Hampton Avenue Bridge, east of North 32nd Street; and, be it
Further Resolved, That this permission is granted only on the conditions that the MMSD shall:
1. Hold the City of Milwaukee or its agents harmless and accept responsibility for any and all liabilities that may arise through implementations of the permission granted herein.
2. Obtain the necessary Department of Public Works permit prior to installation of the conduits and any other related items within the right-of-way.
3. Install the conduits as shown on the plan with "as-built" plans shall be submitted to the City Engineer to show the actual installation.
4. Whenever the conduits or devices are no longer needed or when so ordered for public necessity, not only remove these items but shall also restore to its former condition and to the approval of the Commissioner of Public Works any public improvement which was removed, changed or disturbed by reason of the granting of this resolution. Grantee shall not be entitled to any damages for such removal.
