Substitute resolution approving levying of assessments and construction of assessable public improvement projects at various locations.
Analysis
This resolution confirms the report of the Commissioner of Public Works, as modified by the Common Council Committee, on projects for which Public Hearings have been held.  The resolution authorizes the levying of special assessments and directs the installation and construction of said public improvements.

Whereas, The Common Council of the City of Milwaukee adopted preliminary resolutions, determining it necessary and in the public interest to construct and levy special assessments for the following improvements:

N. Fratney St. (Extended) - N. Commerce St. to E. Reservoir Ave. (SW170030101/TD02284021) File Number 030459:  New sanitary sewer. (Assessable Expansion of Capacity Sewer Fund -- $5,200; Nonassessable T.I.D. - 22 Funds -- $17,900)
 
E. Reservoir Ave. - E. Garfield Ave. to Kilbourn Park (WT420030004/TD02284021) File Number 030392:  New water main. (Assessable Water Fund -- $44,200; Nonassessable T.I.D.- 22 Funds -- $95,800)
 
E. Reservoir Ave. - E. Garfield Ave. to Kilbourn Park (TD02284040/ST211030143) File Number 030264:  Asphalt pavement construction, place curb and gutter, construct retaining wall, place sidewalk and driveway approaches where needed, sodding, and grading. (Assessable Reconstruction Paving Fund -- $99,700; Nonassessabale T.I.D. - 22 Funds --$116,300)

Alley between W. Brown St., W. Vine St., N. 17th St., and N. 18th St. (Northerly East-West Leg) (ST212030136) File Number 030038:  Concrete alley pavement reconstruction, replace some abutting walk or driveway approaches, grading, and storm drainage facilities where needed. (Assessable Alley Paving Fund -- $17,700; Nonassessable Alley Paving Fund -- $20,600)

Whereas, The report of the Commissioner of Public Works has been filed with the City Clerk; and
 
Whereas, Notices have been sent to all interested persons and public hearings held; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works' Report, as amended at said Public Hearing, is approved and the properties therein identified are benefited; and, be it
 
Further Resolved, That said Commissioner of Public Works is authorized and directed to proceed with said work in accordance with said report pursuant to Section 66.0703 and any other pertinent sections of the Wisconsin Statutes and in the manner directed by Section 115-42 of the Milwaukee Code of Ordinances; and, be it
 
Further Resolved, That the proper City departments take such action as is required of them to assess the abutting or adjacent properties and collect such assessment in the manner directed by Section 115-42 of the Milwaukee Code of Ordinances, and, be it
 
Further Resolved, That the City Comptroller is authorized and directed to transfer such funds which are available for this purpose to the appropriate capital Project/Grant accounts; and, be it
 
Further Resolved, That the projects do not involve any parcels of agricultural land which are eligible for deferred special assessments under the provisions of Section 14.30 of the Milwaukee City Charter; and, be it
 
Further Resolved, That for tax key number 354-0545-111-3, the special assessments for sanitary sewer, storm sewer, and water main in E. Reservoir Ave. (SW170030102/TD02284021 and WT420030004/TD02284021) be deferred until application for connections to said sanitary sewer, storm sewer, and water main is made.  Cost for deferred charges shall be in accordance with City Charter 12-10 and 14-18 respectively, and, be it
 
Further Resolved, That projects: N. Fratney St. (SW170030101/TD02284021), E. Reservoir Ave. (TD02284040/ST211030143), E. Reservoir Ave. (WT420030004/TD02284021), E. Reservoir Ave. (SW170030102/TD02284021), N. Riverboat Rd. (TD02284020/ST211030144), and Alley W. Brown St. (ST212030136) will be billed after January 1, 2005, but not before 12 months after the project contract has been completed.
