Analysis

This resolution authorizes the Commissioner of Public Works and the Comptroller to amend two agreements previously authorized by Common Council File Number 061402, which authorized the Commissioner of Public Works and the Comptroller to enter into two funding agreements with the Wisconsin Department of Transportation for installation of light emitting diode signal indications at 162 intersections under 2007 Highway Safety Improvement Program.  Due to the increased costs of material and labor, the cost of two Local Force Account - Local Contracts has increased $153,971.18 ($138,574.06 grantor/$15,397.12 City) or 18.35 percent to $839,019.21, with an amended grantor share of $755,177.29 and an amended City share of $83,901.92.

Whereas, The Common Council has previously approved File Number 061402, which authorized the Commissioner of Public Works and the Comptroller to enter into two funding agreements with the Wisconsin Department of Transportation (WISDOT) for the installation of light emitting diode (LED) signal indications at 162 intersections under 2007 Highway Safety Improvement Program; and

 

Whereas, Costs for materials and labor have increased; and

 

Whereas, The revised estimated cost for these agreements is $839,019.21, an increase of $153,971.18 or 18.35% over the original estimated cost of $685,048.03 for the installation of light emitting diode signal indications; and

 

Whereas, Ninety percent of the participating project cost, or $755,117.29, is reimbursable from WISDOT and should be earmarked for this project in the 2007 Capital Grant and Aids Projects Fund Project/Grant Number SP032070100; and

 

Whereas, Ten percent of the participating project cost, or $83,901.92, is included in the Division’s 2007 Capital Purpose Project/Grant Number ST320070000; and

 

Whereas, The increased costs for this project are greater than ten percent over the amount preciously authorized, which requires further approval by the Common Council; and

 

Whereas, The State cannot proceed with any project cost overruns and/or changes in scope of more than five percent without prior Department of Public Works approval; and

 

Whereas, The Department of Public Works shall notify the Common Council of the City of Milwaukee at the next scheduled meeting of any such project cost overruns and/or changes in scope approved by the Department of Public Works; and

 

Whereas, The Common Council of the City of Milwaukee recognizes that the City may be 100% liable for any such project cost overruns and/or changes in scope as approved by the Department of Public Works; and

 

Whereas, The Common Council of the City of Milwaukee recognizes that the City may be liable for any costs incurred by the State should the City decide to withdraw from the project; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works and Comptroller are authorized to amend two funding agreements with WISDOT for the installation of light emitting diode signal indications at 162 intersections under 2007 Highway Safety Improvement Program based on a predetermined estimate prepared under the Federal/State aided highway program, a copy of which is attached to this resolution, and is incorporated into this resolution as though set forth in full; and, be it

 

Further Resolved, That upon approval of this contract, the Commissioner of Public Works is directed to install LED signal indications at 162 intersections included as part of this agreement; and, be it

 

Further Resolved, That upon approval of this contract, the City Comptroller is hereby authorized to add to the existing Project/Grant accounts from the Capital Grant and Aid Projects Fund by transferring to these accounts the amount required under the agreement and City accounting policy, but not to exceed a ten percent increase of the total amounts reserved for the grantor’s share and local share or $5,000, whichever is greater as follows:
