Whereas, Milwaukee Habitat For Humanity, Inc. has submitted an Offer to Purchase, in the amount of $1 each, the following City-owned vacant lots for construction of 13 single-family homes for qualified owner-occupants:

Whereas, The Department of City Development (“DCD”) recommends acceptance of said Offer contingent upon final site and building plan approval prior to closing on said lots; and
Whereas, A portion of several of said lots were previously sold to adjoining owners for use as green space and the deeds conveying the lots contain restrictions that will not permit assemblage or division of the properties nor new construction; and
Whereas, Removal of the deed restrictions is necessary to build housing on said lots; and
Whereas, Said lots are to be sold in an “as is” condition without representations or warranties including but not limited to soil quality and subsurface condition; and
Whereas, The City Plan Commission has determined that there is no municipal need for said lots; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that said vacant lots are declared surplus, that the Offer to Purchase from Milwaukee Habitat For Humanity, Inc. is accepted and that the Commissioner of DCD or designee is authorized and directed to perform such acts as necessary to carry out the intent of this resolution; and, be it
Further Resolved, That to facilitate redevelopment, the Commissioner of DCD, or designee, is authorized to prepare the proper documents releasing the deed restrictions that will not permit assemblage, division or construction on said lots; and, be it
Further Resolved, That the proceeds from said sale be credited to the appropriate accounts.
