This resolution authorizes a variance from Administrative Rules and construction of certain public improvements which are to be financed by a developer in accordance with an agreement previously approved by the Common Council.
BODY:
Whereas, On January 20, 1998, the Common Council of the City of Milwaukee adopted Resolution File Number 971412 authorizing an out of program agreement between the developer of Humboldt Yards and the City of Milwaukee for the construction and installation of required improvements in certain public ways:
N. Commerce St. - N. Humboldt Ave. to W. North Ave. (959-0371-5) File Number 971863: Concrete pavement construction, curb and gutter and sidewalk and driveway approaches, sodding, and grading. (Developer Paving Fund 72-523---210-8000 -- $210,000)
N. Commerce St. - N. Humboldt Ave. to W. North Ave. (961-0310-0) File Number 980184: Install combined sewer. (Developer Sewer Fund 72-523---170-8000 -- $200,000)

in the 6th Aldermanic District of the City of Milwaukee; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that a variance is authorized from the procedures of File Number 881665, being the Administrative Rules for the Capital Improvements Process, and hereby directs the City Comptroller to make a supplemental appropriation of $100,000 in the Sewer Developer Out-of-Program Capital Purpose Account 72-523---170-8000) with offsetting revenues in Sewer Estimated Revenue 72-523---170-9003, and $50,000 in the Water Developer Out-of-Program Capital Purpose Account 42-641---301-0001 with offsetting revenues in Water Estimated Revenue 42-641---301-9003; and, be it
Further Resolved, That the City Comptroller is hereby authorized to make the necessary funding and accounting entries, including increasing the Environmental Engineering and Milwaukee Water Works' Developer Out-of-Program Capital Purpose Accounts and offsetting revenues to appropriately reflect the intent of this action and assure adequate cost recovery; and, be it
Further Resolved, That after the developers of said development deposit the necessary funds in accordance with said agreement, the Commissioner of Public Works is authorized and directed to proceed with said work.
