Analysis
This resolution approves a Transfer Agreement by and between the City of Milwaukee (Milwaukee Police Department) and American Legion Milwaukee Post No. 415.  Under the terms of the Transfer Agreement, all of the City's interest in the vehicle will be transferred to American Legion Milwaukee Police Post No. 415 for $1.00 and other good and valuable consideration and the commitment by the Transferee to observe all terms and conditions of the Transfer Agreement.  Those conditions include a commitment that the City will have the right to use the vehicle for appropriate public relations purposes and Transferee commits to making the vehicle available under those terms and conditions.   The Transferee commits not to attempt further transfer of the vehicle without the City's consent.  The Transferee further commits to maintaining appropriate insurance on the vehicle for the benefit of the City of Milwaukee.
Body
Whereas, The police department of the City of Milwaukee (the City) is in possession of an antique 1948 Plymouth Coupe currently painted in the livery of the Milwaukee Police Department squad car of that era; and
 
Whereas, Pursuant to ยง 62.13, this property is in the custody of the Chief of Police of the City of Milwaukee; and
 
Whereas, The Chief of Police of the City of Milwaukee has determined that the vehicle has no utility as a tool of law enforcement, and further wishes to avoid the expense of maintaining the vehicle; and
 
Whereas, The Transferee has agreed to undertake the expense of the maintenance of the vehicle, and to make the vehicle available to the City for appropriate use as a public relations tool; and
 
Whereas, The acceptance of this responsibility and relieving the City of same is adequate and fair consideration for the transfer; and
 
Whereas, The American Legion of Milwaukee Police Post No. 415 is a charitable organization recognized as tax exempt not-for-profit under 501(c)(19) of the Internal Revenue Code; and
 
Whereas, In accordance with the terms and conditions which are set forth in the Transfer Agreement attached to this file; now, therefore, be it
 
Resolved, That the Common Council of the City of Milwaukee hereby authorizes and directs the Chief of Police to execute the Transfer Agreement, a copy of which is attached to this file; and, be it
 
Further Resolved, That minor substantive changes may be made in the final form of the Transfer Agreement if the changes are approved by the City Attorney, the Chief of Police of the City of Milwaukee, and an appropriate officer of American Legion Milwaukee Police Post No. 415.
