Title
Substitute resolution approving Intergovernmental Cooperation Agreements with the Milwaukee Board of School Directors for Police Services.
Analysis
This resolution approves 2 Intergovernmental Cooperation Agreements between the City and the Milwaukee Board of School Directors (“Board”) for the provision of specified law enforcement services to the Board under the agreement. The City Police Department (“MPD”) shall assign officers to work as School Resource Officers (“SROs”) in the School Security Pilot Program on a full-time basis during the second semester of the 2006-2007 school year. Two SROs will be assigned to the Lynde and Harry Bradley Technology and Trade School (“Bradley Tech”) under one agreement and 2 to the schools which comprise “the Cluster Schools” under the other. Duties shall commence February 7, 2007and conclude on June 15, 2007. The Board will reimburse the City for actual and indirect costs of services performed at the Cluster Schools, not to exceed $75,000 in one semester unless the parties agree otherwise in writing. The agreement, which extends from 2/7/07 to 6/15/07, may be terminated upon written notice or renewed for the first semester of the 2007-2008 school year. For the purpose of measuring the successfulness of the School Security Pilot Program, MPD and MPS shall provide one another with the data set forth by this Agreement as reasonably requested.
Body
Whereas, The Milwaukee Board of School Directors (“Board”) and the City of Milwaukee (“City”) both qualify as “municipalities” authorized to enter into contracts for the receipt or furnishing of services pursuant to section 66.0301 of the Wisconsin Statutes; and
Whereas, The City and the Board are dedicated to establishing and maintaining a positive partnership that promotes prevention, intervention, education and enforcement as a means of improving the safety and security in and around Milwaukee Public Schools (“MPS”) schools for staff, students, parents and the community; and
Whereas, The Board acting pursuant to section 66.0301 has requested the City Police Department (“MPD”) to assign officers to work as School Resource Officers (“SROs”) in the School Security Pilot Program on a full-time basis during the second semester of the 2006-2007 school year; and
Whereas, Two SROs will be assigned to the Lynde and Harry Bradley Technology and Trade School (“Bradley Tech”), and 2 to the schools which comprise “the Cluster Schools,” and duties shall commence February 7, 2007 and conclude on June 15, 2007; and
Whereas, MPS shall pay the City a sum equal to the costs of the actual salaries, fringe benefits and overtime, plus indirect costs, of the 2 SROs assigned to the Cluster Schools under this Agreement, not to exceed $75,000 in one semester unless the parties agree otherwise in writing; and
Whereas, These Agreements may be terminated by either party for convenience, upon 90 days notice in writing in the case of Bradley Tech and 90 days notice in the case of the Custer Schools, or may be extended to cover the first semester of the 2007-2008 school year under the same terms and conditions that exist in these Agreements without further approval of either the Common Council or the Board; and
Whereas, For the purpose of measuring the successfulness of the School Security Pilot Program, MPD shall document data relating to many of its tasks, and MPD and MPS shall provide one another with the data set forth by this Agreement as reasonably requested; and
Whereas, On January 26, 2007, the Board approved these Intergovernmental Cooperation Agreements and authorized the appropriate MPS officials to execute these Agreements; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Intergovernmental Cooperation Agreements with the Milwaukee Board of School Directors for Police Services are approved; and, be it
Further Resolved, That the Chief of Police is authorized to execute the Agreements with the Board, copies of which are attached to this file; and, be it
Further Resolved, That the City Comptroller is authorized to:
1. Commit funds within the Project/Grant Parent of the 2007 Special Revenue-Grant and Aid Projects Fund, the following amount for the school security pilot program:

2. Create the necessary Grant and Aid Project/Grant and Project/Grant levels, budget against these Project/Grant values the amount required under the grant agreement;
Establish the necessary City Share Project Values; and, be it
Further Resolved, That these funds are budgeted for the Milwaukee Police Department, which is authorized to:
1. Expend from the amount budgeted sums for the specified purposes, as indicated in the grant budget and incur costs consistent with the award date.
2. Transfer funds within the project budget as long as the amount expended for each specific purpose does not exceed the amount authorized by the budget by 10%.
