Analysis
To implement the provisions of the 2005 city budget, this ordinance:
 
1.  Removes major appliances from the definition of "bulky waste," meaning that appliances will no longer be collected by the department of public works at no charge.
 
2.  Reduces the maximum volume of trees, logs and branches that will be collected by the department of public works at no charge from 5 cubic yards to 4 cubic yards, and limits such collection to the months of April through November.
 
3.  Authorizes the commissioner of assessments to assess and collect service charges for inspection and appraisal of new construction, remodeling and additions, so that the costs associated with providing these services may be recovered.  The amounts of the service charges for inspection and appraisal are also specified.
 
4.  Increases the fees for the provision of police services at special events by 36-38%.
 
5.  Increases, from $50 to $75, the monthly fee for failure to comply with an order to record a residential or commercial property.   
 
6.  Removes "safety-related coordination" from the list of responsibilities of the department of administration to reflect the fact that responsibility for this area lies with the safety commission, which receives staff support primarily from the police department.
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
 
Part 1.  Section 79-1-12-a of the code is amended to read:
 
79-1.  Definitions.
 
12.  SOLID WASTE consists of the following categories:
 
a.  Bulky waste is discarded articles of such dimension as are not normally collected with domestic waste including, but not limited to, [[items such as appliances, stoves and]] furniture designed or manufactured for indoor use, including, but not limited to, upholstered furniture, left exposed in an outdoor area, including unenclosed porches.  The term [[includes]]  >>does not include<< major appliances as defined in s. 79-23-10.   
 
Part 2.  Section 79-2-8 of the code is amended to read:
 
79-2.  Collection Regulations.
 
8.  DOMESTIC TREE AND BULKY WASTE.  Trees, logs, and branches generated in normal household maintenance not exceeding [[5]] >>4<< cubic yards and bulky waste of domestic origin shall be collected by the department >>between April 1 and November 30<< .  Such waste shall be stored and handled in an approved manner and not contrary to any order of the commissioner of health or the commissioner of neighborhood services.  Collection shall be scheduled as practical by the department.
 
Part 3.  Section 81-6 of the code is created to read:
 
81-6.  Service Charges for Appraisal and Inspection.  Service charges for inspection and appraisal of new construction, remodeling and additions by the commissioner of assessments shall be as follows:
 
1.  NEW CONSTRUCTION.
 
a.  One-family: $150.
 
b.  Two-family: $300
 
c.  Multi-family: $300 plus $100 per unit over 2 units.
 
d.  Commercial, industrial or public: $0.03 per square foot, with a minimum charge of $500.
 
2.  ALTERATIONS AND ADDITIONS.
 
a.  Residential: 0.25% of construction cost, with a minimum charge of $10.
 
b.  Commercial: 0.25% of construction cost, with a minimum charge of $20.
 
c.  Siding, deck, garage, air conditioning, fireplace or razing: $10.

Part 4.  Section 81-114.6-1 to 3 of the code is amended to read:
 
81-114.6.  Special Events - City Services.
 
1.  Class A Event: [[$1,360]] >>$1,850<< .
 
2.  Class B Event: [[$   290]] >>$   400<< .
 
3.  Class C Event: [[$     80]] >>$   110<< .
 
Part 5.  Section 200-33-49.6 of the code is amended to read:
 
200-33.  Fees.
 
49.6.  RESIDENTIAL AND COMMERCIAL BUILDING RECORDING CODE ENFORCEMENT FEE.  A monthly fee of [[$50]] >>$75<< may be charged for failure to comply with an order to record a property as required by and in accordance with s. 200-51.5.
 
Part 6.  Section 307-6 of the code is created to read:
 
307-6.  Service Charges for Inspection and Appraisal.  In order to recover costs associated with inspection and appraisal of new construction, remodeling and additions, the commissioner of assessments is authorized to assess and collect service charges for providing inspections and appraisals.
 
Part 7.  Section 310-1-9 of the code is amended to read:
 
310-1.  Department Established.
 
9.  Citywide emergency [[and safety-related]] >>response<< coordination.
