Substitute resolution authorizing and directing the proper City officials to execute a Memorandum of Understanding with the Milwaukee Metropolitan Sewerage District for the funding, construction, maintenance and operation of a bioretention stormwater treatment facility in the Menomonee Valley to be constructed in conjunction with the Canal Street Reconstruction project.
Body
Whereas, It is the Department of Public Works (DPW's) goal to provide innovative and effective stormwater management measures in the reconstruction/extension of Canal Street and redevelopment of the Menomonee Valley; and
 
Whereas, DPW, DCD, and stakeholders, have developed a comprehensive stormwater management plan employing strategically located bioretention facilities to effectively treat stormwater generated on both public and private lands in the Menomonee Valley; and
 
Whereas, Bioretention is an emerging technology that utilizes a permeable soil medium planted with native vegetation designed to absorb and filter stormwater runoff while maximizing evapotranspiration thus improving quality and reducing quantity of stormwater discharged into the environment; and
 
Whereas, Given the magnitude of the Stormwater Management Plan for the Menomonee Valley, it is DPW's and DCD's intent to implement the plan incrementally as opportunities occur; and
 
Whereas, The 35th Street to Miller Park portion of the stormwater management plan shall be implemented in conjunction with the ongoing CMC Shops TID site preparation; and
 
Whereas, The 6th to 11th Street portion of the Stormwater Management plan shall be implemented in conjunction with future redevelopment of lands located at 6th and Canal; and
 
Whereas, The initial phase of the 11th to 35th Street portion of the Stormwater Management Plan shall be implemented in conjunction with the ongoing reconstruction of West Canal Street; and
 
Whereas, The remaining phase of the 11th to 35th Street portion of the Stormwater Management Plan shall be implemented in conjunction with future redevelopment efforts in the central Menomonee Valley; and
 
Whereas, The main component of the initial phase of the 11th to 35th Street portion of the Stormwater Management Plan includes a bioretention facility located at 25th and Canal, a stormwater lift station, and necessary conveyance facilities as well as conveyance facilities to facilitate future implementation of the remaining phase of the 11th to 35th Street portion of the Stormwater Management Plan; and
 
Whereas, The initial phase of the 11th to 35th Street portion of the Stormwater Management Plan also includes increased frequencies of street sweeping on Canal Street and other temporary measures for an interim time period until the ultimate Stormwater Management Plan for the Menomonee Valley is implemented; and
 
Whereas, Capital costs for the initial phase of the 11th to 35th Street portion of the Stormwater Management Plan are estimated at $2.35M; and
 
Whereas, MMSD has expressed an interest in participating in the cost to implement the initial phase of the 11th to 35th Street portion of the Stormwater Management Plan in an amount not to exceed $682,500; and
 
Whereas, Remaining costs to implement the initial phase of the 11th to 35th Street portion of the Stormwater Management Plan shall be funded through Canal Street accounts as authorized in Common Council Resolution File Number 031256 (Canal, Streets, City Share, Fund No. 0333, Project Grant No. ST 320000000, Non-Assessable); and
 
Whereas, DPW will be responsible for operation, monitoring, and maintenance of the stormwater facilities including storm sewers, lift station, and bioretention facilities; now, therefore, be it
 
Resolved: By the Common Council of the City of Milwaukee, that the proper City officials are authorized and directed to execute a Memorandum of Understanding (MOU) with the Milwaukee Metropolitan Sewerage District for the funding, construction, maintenance, and operation of a bioretention stormwater treatment facility in the Menomonee Valley to be constructed in conjunction with the reconstruction of West Canal Street, a draft copy of which is attached to Common Council Resolution File Number 040007, and is incorporated in this resolution by reference as though set forth in full; and, be it
 
Further Resolved, That minor changes to the draft MOU which do not change the intent of the agreement are hereby approved; and, be it
 
Further Resolved, That the Commissioner of Public Works is authorized and directed to let contracts for construction related work associated with this project; and, be it
 
Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Improvement Fund, Grant and Aid Projects, the necessary Project/Grant Chartfield Values for construction of the bioretention facility in conjunction with construction of Canal Street between North 6th Street and North 35th Street (Expenditure and transfer to any of these accounts the amount required under the grant agreement and City Accounting Policy but not to exceed a 10 percent increase of the total amounts reserved for the grantor's share and local share, or $5,000, whichever is greater), as follows:
