Resolution approving an Out-of-Program Agreement between the City of Milwaukee and Gerd Voelker for the design and installation of public improvements to serve a proposed six lot, single family residential subdivision to be located generally west of North 107th Street and north of West Tower Avenue extended. - ANALYSIS - This resolution approves an Out-of-Program Agreement between the City of Milwaukee and Gerd Voelker, a private property owner. The agreement identifies the public improvements required to support a proposed six lot, single family residential subdivision and the funding sources for the improvement costs. The subdivision will be located generally west of North 107th Street and north of West Tower Avenue extended. Mr. Voelker will pay for a public improvement costs with two exceptions: 1) The City will pay for storm sewer main improvements estimated to cost $20,000 using TID #36 as the funding source, and 2) The City of Milwaukee Water Works will pay 50% of the water main improvement costs estimated to cost a total of $25,000.
BODY:
Whereas, The City of Milwaukee has recently approved a Development Agreement and associated Out-of-Program Agreement for a mixed use development to be known as Granville Park located generally west of North 107th Street and south of West Brown Deer Road, and
Whereas, Mr. Gerd Voelker owns vacant property immediately adjacent to this project and wishes to develop his land in conjunction with the Granville Park project; and
Whereas, Granville Park has been designed to accommodate Mr. Voelker's proposed six lot, single family residential subdivision; and
Whereas, A Tax Incremental Finance District (TID #36) has been created to fund a portion of the public improvement costs for the Granville Park project; and
Whereas, This TID could also be used to fund a portion of the public improvement costs associated with Mr. Voelker's proposed subdivision; and
Whereas, The City of Milwaukee Water Works has determined that a loop water main system would best serve the proposed subdivision and that half of the cost for this loop system could be funded by the Water Works; and
Whereas, Mr. Voelker has agreed to fund all other public improvement costs; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the Out-of-Program Agreement attached to the file as Exhibit "A" is hereby approved; and, be it
Further Resolved, That the Commissioner of Public Works is authorized to make minor, non-substantive changes in the Out-of-Program Agreement prior to its execution; and, be it
Further Resolved, That the appropriate City Officials are hereby directed to establish the required funding accounts to accomplish the intent and purpose of this resolution.
