Analysis

This ordinance revises various provisions of the code for purposes of correcting errors, clarifying language, eliminating obsolete provisions and updating references.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1. Section 68-21-2-g-3 of the code is amended to read:

 

68-21. Licensure of Food Establishments; General.

2. EXCEPTIONS.

g.

g-3. A food peddler with a food peddler license who operates on private property as part of a festival as defined in [[s. 108-1-2.5]] >>s. 108-3-2.5<<, street festival as defined in [[s. 95-1-2]] >>s. 92-1-9<<, or special event as defined in s. 105-55.5, provided the food operation remains unchanged from that conducted routinely under the operator’s existing food peddler license. 

 

Part 2. Section 79-1-13 of the code is amended to read:

 

79-1. Definitions.

13. WASTE TIRE means a tire that is no longer suitable for its original purpose because of wear, damage or defect. [[The term includes an unserviceable tire as defined in s. 84-48.]]

 

Part 3. Section 105-55.5-2-b-6 and e of the code is amended to read:

 

105-55.5. Special Event Permits.

2. APPLICATION.

b. Contents of Application

b-6. If an applicant for a permit will be conducting a street festival as defined in [[s. 95-1-2-j]] >>s. 92-1-9<<, the applicant shall provide a list of all persons and their respective permanent addresses, including peddlers and solicitors, who have obtained permission from the respective festival organization to sell goods or take orders for the later delivery of goods within the barricaded area of the street festival, no later than 2 working days prior to each event for all non-food vendors and 7 working days for food vendors.

 

e. Fees. The applicant for a special event permit shall pay the appropriate fee for the city services set forth in [[s. 81-114-6]] >>s. 81-114.6<<, no later than 3 days prior to the date of the special event. The commissioner of public works may establish fees for provision of additional city services requested by the applicant not set forth in s. 81-114-6.  Permits shall be issued upon payment of appropriate fees.

 

Part 4. Section 200-33-26-b-0, b-1 and b-2-b of the code is amended to read:

 

200-33. Fees.

26. LICENSED DWELLING FACILITIES.

b. [[Hotels]] >>Hotel or Motel<<. b-1. The fee for a hotel >>or motel<< permit shall be $600.  A portion of the fee shall be used to pay the state of Wisconsin administrative fee, the amount of which is on file with the department of neighborhood services.

 

b-2-b. For a hotel or motel with >>more than<< 50 [[or more]] rooms: $350.

 

Part 5. Section 295-907-2-c-13 of the code is amended to read:

 

295-907. Planned Development District (PD/DPD).

2. PROCEDURES.

c. Application Requirements; Detailed Plan.

c-13. A statement that the time period specified pursuant to [[subd. 11]] >>subd. 12<< may be extended only by an ordinance amending the detailed planned development, pursuant to s. 295-307.

 

Part 6. Section 320-15-1 of the code is amended to read:

 

320-15. Board of Public Land Commissioners (City Plan Commission).

1. CREATED.  There is created, pursuant to s. 27.11, Wis. Stats., a board of public commissioners, which for convenience of identification, shall be known and referred to as the city plan commission, consisting of 7 citizen members, with the same purposes, powers, functions and terms as boards of public land commissioners created under s. 27.11, Wis. Stats. The board shall exercise all the powers conferred on city plan commissioners under [[s. 62.33, Wis. Stats]] >>s. 62.23, Wis. Stats.<<.

 

Part 7. Section 350-244 of the code is amended to read:

 

350-244. Relocation Expense Reimbursement for Nursery Manager.  The department of public works may make a relocation expense reimbursement to any employee of the department who is promoted to or hired for the position of nursery manager and is required to live at the city nursery as a condition of his or >>her<< employment.  The payment of the relocation expense reimbursement shall be in accordance to the conditions specified under s. 350-243-2 to 7.
