Resolution authorizing the proper City officials to enter into a Vault Sidewalk Slab Replacement Reimbursement Agreement in the King Drive Improvement Program area. (DCD)

ANLS:

- Analysis -

This resolution authorizes the proper City officials to enter into Agreements which would provide funds in the amounts of up to $8,000 for replacing the wearing surfaces of hollow sidewalks at 2007 and 2039 North Dr. Martin Luther King, Jr. Drive so that they will conform with the streetscape improvements previously approved for and constructed in this project.

BODY:

Whereas, The City of Milwaukee ("City") has approved an ongoing program providing streetscape and related public infrastructure improvements which are intended to promote neighborhood and commercial revitalization/development activities along North Dr. Martin Luther King, Jr. Drive; and

Whereas, The King Drive Improvement Program (Account No. 31-630-0001) provides funds specifically for the replacement of sidewalk slabs, the installation of granite paver strips, pedestrian lighting fixtures, street trees with grates and guards or planter boxes in lieu thereof, and other appropriate streetscape amenities for the purpose of promoting private investment and encouraging greater pedestrian usage within the improvement area; and

Whereas, Certain property owners use hollow-walk vaults in the public sidewalk adjacent to the streetscape project and maintain these vaults as a permissible encroachment allowed by Section 245-5 of the Milwaukee Code of Ordinances and by permits granted by the City; and

Whereas, It is desirable to replace the wearing surfaces of these vaults to conform in design and appearance with the streetscape improvements installed on North Dr. Martin Luther King, Jr. Drive between West Walnut Street and West Garfield Avenue; and

Whereas, It is the intent of the City to treat owners with sidewalk vaults in like manner as those owners of properties within the streetscape project without vaults wherein sidewalk replacement and streetscape improvements have been installed at no cost to such owners; and

Whereas, The City's contribution to certain owners with sidewalk vaults would aid in the improvement of the public walks thereover to the standards established by the subject program for the area; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee that replacement of the sidewalk slabs on hollow-walk vaults within the North Martin Luther King Drive Improvement Program area (Account No. 31-630-0001) promotes a public purpose and City contributions to owners of property adjacent to such hollow-walk vaults are in aid of public sidewalk improvements; and, be it

Further Resolved, That the proper City officials are authorized and directed to enter into Vault Sidewalk Slab Replacement Reimbursement Agreements with the owners of the properties at 2007 and 2039 North Dr. Martin Luther King, Jr. Drive as referred to in Exhibits A and B, copies of which are attached to this Common Council File, utilizing funds from Account No. 31-630-0001; and, be it

Further Resolved, That the Commissioner of the Department of City Development, in consultation with the Commissioner of Public Works and the City Attorney, may make nonsubstantive changes to Exhibits A and B based on verifiable costs for the work therein described.
