This substitute resolution authorizes the Department of Public Works to accept a Wisconsin Nonpoint Source Water Pollution Abatement Grant. Funding under this grant will enable the City to reduce the amount of pollution in storm water runoff.
 
 
BODY:
Whereas, Common Council File Number 890529 was adopted on 7/25/89 and approved the application, acceptance and funding of the Nonpoint Source Water Pollution Abatement Nonpoint Grant from 8/30/89 through 9/30/92 with an original grant amount of $469,751; and
 
Whereas, Common Council File Number 931320 was adopted on 12/22/93 and approved the acceptance and funding of the Nonpoint Source Water Pollution Abatement Nonpoint Grant from 1/1/94 through 12/31/95 with a grant amount of $1,350,000 of which the Grantor share was $845,000 and the In-Kind City share was $505,000; and
 
Whereas, The actual award received, dated 12/22/93 was from 1/1/94 through 12/31/99 with a grant amount of $1,135,000 of which the Grantor share was $600,000 and the In-Kind City share was $505,000; and
 
Whereas, Common Council File Number 941450 was adopted on 1/24/95 and approved the acceptance and funding of the Nonpoint Source Water Pollution Abatement Nonpoint Grant from 1/1/95 to 12/31/95 with a grant amount of $821,428 of which the Grantor share was $400,000 and the City local share was $421,428; and
 
Whereas, Common Council File Number 941450 was amended on April 25, 1995 by Common Council File Number 941964 and approved total grant project funding of $2,231,428 of which the Grantor share was $1,900,000 and the Local City share was $421,428 for the period of 1/1/95 through 12/31/95; and
 
Whereas, Common Council File Number 951243 was adopted on 12/19/95 and approved the acceptance and funding of the Nonpoint Source Water Pollution Abatement Nonpoint Grant from 1/1/96 through 12/31/96 with a grant amount of $71,428 of which the total Grantor share was $50,000 and the In-Kind City share was $21,428; and
 
Whereas, Common Council File Number 961649 was adopted on April 23, 1997 and approved the acceptance and funding of the Nonpoint Source Water Pollution Abatement Nonpoint Grant from 1/1/97 through 12/31/97 with grant amounts of $14,285 of which the Grantor share was $10,000 and the In-Kind City share was $4,285; and
 
Whereas, No new grant funds were available from the Grantor in 1998 and 1999; and
 
Whereas, The total grant project cost for 8/30/89 to 12/31/99 is $4,601,297 of which the Grantor share is $3,260,751 and the Out-of-Pocket City share is $299,405 and the In-Kind City share is $1,051,141; and
 
Whereas, Under the terms of Section 144.25 of the Wisconsin Statutes and Chapter NR 120.08 of the Wisconsin Administrative Code, the City of Milwaukee appears to be eligible for additional grant funds from the Department of Natural Resources for a Nonpoint Source Water Pollution Abatement Local Assistance Grant; and
 
Whereas, The Grantor would provide $56,000 to the Third Ward Business Improvement District for the creation of an experimental storm water management system in the Historic Third Ward Riverwalk area; and
 
Whereas, The estimated total cost of this project is $112,000 of which $56,000 (50%) would be grant funded and $56,000 (50%) would be Historic Third Ward Association match; and
 
Whereas, There is no local Out-of-Pocket City Share required to receive the grant; and
 
Whereas, It would appear that City involvement in a grant and aid project involving the abatement of nonpoint source water pollution would result in the following major benefit to the City:
 
--Reducing the amount of pollution in storm water runoff; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that the proper City officials and/or the herein named department head are hereby authorized to accept such a grant without further Common Council approval; and, be it
 
Further Resolved, That the City Comptroller is authorized to:
 
1.      Commit Funds within the Project/Grant Parent of the 2000 Capital Revenue Grant and Aid Projects, Fund the following amounts for the program/project titled Wisconsin Nonpoint Source Water Pollution Abatement Grant Project:

2.      Create a Capital Revenue Fund - Grant and Aid Projects and the necessary Project/Grant Chartfield Values at the Project, Segment, Phase and/or Activity Levels; and to budget to the Project, Segment, Phase or Activity level the amount required under the grant agreement; and
 
3.      Establish the necessary City Share Project Values; and, be it
 
Further Resolved, That these funds are budgeted for the Department of Public Works, which is authorized to:
 
1.      Expend from the amount budgeted for specific purposes as indicated in the grant budget and incur costs consistent with the grant award; and, be it
 
Further Resolved, That the funds received from the Department of Natural Resources be deposited in accordance with procedures established by the City Comptroller.
