Title

Analysis

Adoption of this resolution by at least two-thirds vote of the Common Council of the City of Milwaukee will approve the blight designation of the subject City-owned properties for acquisition by the Redevelopment Authority of the City of Milwaukee utilizing the Spot Acquisition procedures set forth in Section 66.1333, Wisconsin Statutes, and will allow the City to assign to the Redevelopment Authority the City’s Option to Purchase.

Body

Whereas, By adoption of File No. 040466, the Common Council of the City of Milwaukee (“Common Council”) approved the surplus declaration of the City-owned properties at 2941-55, 2963 and 3009 North Humboldt Boulevard and authorized an Option to Purchase with Alterra Coffee Roasters (“Alterra”) for industrial and commercial development; and

 

Whereas, The property at 3009 North Humboldt Boulevard had environmental impacts that were remediated using a Brownfield Clean Up Grant from the U.S. Environmental Protection Agency (“EPA”) that was provided to the Redevelopment Authority of the City of Milwaukee (“Authority”) for disbursement; and

 

Whereas, The EPA is requiring that the Authority rather than the City of Milwaukee (“City”) own this property for purposes of the grant; and

 

Whereas, All properties to be sold to Alterra should be in common ownership for preparation of closing documents; and

 

Whereas, In order for the Authority to acquire property that is not located in a redevelopment project area, the Authority must hold a public hearing and declare the property blighted pursuant to Section 66.1333, Wisconsin Statutes; and

 

Whereas, The Authority held a public hearing on March 16, 2006, after which it determined that the properties at 2941-55, 2963 and 3009 North Humboldt Boulevard met the statutory definition of blight and requested Common Council approval of the blight designation and acquisition by the Authority; and

 

Whereas, The Authority also agreed to accept assignment of the City’s Option to Purchase with Alterra and the public hearing conducted on March 16, 2006, also addressed the disposition of the properties as required by Wisconsin Statutes and as summarized in a Blight Summary and Land Disposition Report (“Report”), a copy of which is attached to this Common Council File; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the City-owned properties at 2941-55, 2963 and 3009 North Humboldt Boulevard are declared blighted pursuant to Section 66.1333, Wisconsin Statutes; and, be it

 

Further Resolved, That the Commissioner of the Department of City Development, or designee, is authorized to transfer the subject properties to the Authority without monetary consideration; and, be it

 

Further Resolved, That the City is authorized to assign to the Authority its Option to Purchase with Alterra and that the Authority is authorized to close the transaction as summarized in the Report.
