Analysis
This ordinance:
1. Excludes the area of any tax incremental district currently in business improvement district #2, with respect to riverwalk design requirements, in which the architectural review board imposes design requirements that cause the cost of riverwalks to exceed $2,000 per linear foot total cost or $1,400 per linear foot city cost and does not provide funding for the excess cost from the business improvement district #2 or other non-city sources.
2. Requires that the architectural review board issue a certificate of appropriateness within 30 days of the submission of the final construction plans.
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Section 308-71-2-e of the code is amended to read:
308-71. Architectural Review Board.
2. DEFINITIONS.
e. "District" means the area designated by common council resolution 870501 as business improvement district #2. This area shall also be known as the "Historic Third Ward Arts District." "District" also means such additional areas as may be designated by the common council. >>The "district" shall exclude the area of any tax incremental district in which the board imposes design requirements that cause the cost of riverwalks to exceed $2,000 per linear foot total cost or $1,400 per linear foot city cost and does not provide funding for the excess cost from business improvement district #2 or other non-city sources. <<
Part 2. Section 308-71-10 of the code is amended to read:
10. CERTIFICATE OF APPROPRIATENESS.
a. Issuance. a-1. If, after the board's review or a hearing, when necessary, the board determines that the application is consistent with the character of the district and the design guidelines, the applicant shall be notified of the board's decision and the board shall issue a certificate of appropriateness. >>The board shall issue a certificate of appropriateness within 30 days of the submission of the final construction plans. <<
