Title
Resolution approving the plat of right-of-way required for the improvement of North Teutonia Avenue between West Ruby Avenue and West Villard Avenue to be undertaken with Federal/State funds under the Surface Transportation Program (STP).
Analysis
This resolution approves the plat of right-of-way required for the improvement of North Teutonia Avenue between West Ruby Avenue and West Villard Avenue, authorizes the City to participate in acquiring lands or interests in lands as shown on the plat of right-of-way required for the project and authorizes the City Comptroller to transfer funds to the proper subaccount for the estimated cost of right-of-way acquisition. The estimated cost of right-of-way acquisition is $330,000, for which the City of Milwaukee's estimated share is $66,000.

Whereas, The Common Council of the City of Milwaukee adopted Resolution File Number 020464 on July 16, 2002, authorizing and directing the Commissioner of Public Works to execute a revised agreement with the Wisconsin Department of Transportation (WISDOT) for the real estate acquisition associated with the improvement of North Teutonia Avenue between West Ruby Avenue and West Villard Avenue with 80% State and/or Federal cost participation under the Surface Transportation Program; and
Whereas, It is necessary that the Common Council approve the plat of right-of-way required for the project and authorize the acquisition of lands or interests, as shown on the right-of-way plat; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the right-of-way plat for North Teutonia Avenue between West Ruby Avenue and West Villard Avenue be approved, a draft copy of which is attached to Common Council Resolution File Number 021182, and is incorporated in this resolution by reference as though set forth in full, and that the City Engineer and the Commissioner of Public Works and Commissioner of the Department of City Development are authorized and directed to affix their signatures to the plat and authorizes the City Engineer to request the WISDOT and/or the Federal Highway Administration for approval to acquire the right-of-way; and, be it
Further Resolved, That upon receiving approval from the WISDOT and/or Federal Highway Administration to proceed with the right-of-way acquisition, the City Engineer is hereby authorized and directed, pursuant to Section 62.22 of the Wisconsin Statutes, to acquire lands or interests in lands, as shown on the approved plat of right-of-way, in the name of the City of Milwaukee; and, be it
Further Resolved, That minor revisions in the above plat to meet altered and unforeseen conditions encountered during acquisition of right-of-way are hereby authorized and approved; and, be it
Further Resolved, That the Commissioner of Public Works is hereby authorized to engage a consultant to act as City's agent in preparing appraisals and in negotiating and acquiring the necessary right-of-way and interests for the project if determined to be in the best interest of the City of Milwaukee; and, be it
Further Resolved, That the City Engineer is hereby authorized and directed to execute all acquisition documents as may be required for the acquisition of the right-of-way; and, be it
Further Resolved, That the City Engineer is hereby authorized and directed to approve and make periodic payments to the WISDOT for the City's share of costs of the right-of-way acquisition for the project; and, be it
Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Improvement Fund, Grant and Aid Projects, the necessary Project/Grant Chartfield Values for the project (Expenditure) and transfer to any of these accounts the amount required under the grant agreement and City Accounting Policy but not to exceed a 10 percent increase in the total amount reserved for the grantor's share and local share or $5,000, whichever is greater, as follows:
