Substitute resolution approving a stipulation between the City of Milwaukee, the Wisconsin Department of Transportation and the Union Pacific Rail System for the reconstruction and maintenance of the South 13th Street Structure over the Union Pacific Railway System tracks in the City of Milwaukee (Infrastructure Services Division).

This substitute resolution approves a stipulation negotiated between the City of Milwaukee, the WISDOT and the Union Pacific Railroad Company for the reconstruction and maintenance of the South 13th Street Structure over the Union Pacific Railway System tracks. Approval of the stipulation will enable the project to be undertaken with 80 percent Federal/State Bridge replacement funds and terminate a prior stipulation for the structure adopted by the Common Council on November 27, 1990 in Resolution File Number 901221. This resolution also authorizes/directs proper City Officials to execute the stipulation. __________________________________________________________________
BODY:
Whereas, The Common Council of the City of Milwaukee adopted Resolution File Number 872623 on May 17, 1988 authorizing and directing the Commissioner of Public Works to execute a program agreement with the Wisconsin Department of Transportation (WISDOT) for programming the reconstruction of the South 13th Street Overpass Structure of the Union Pacific Railway System with Federal and/or State Aid funds under the Local Bridge Replacement Program; and
Whereas, The Common Council by Resolution File Number 901221, adopted November 27, 1990, approved and authorized the execution of a stipulation between the City of Milwaukee, the WISDOT, and the Chicago and Northwestern Transportation Company (CNW) for the construction and maintenance of the South 13th Street overpass structure; and
Whereas, The CNW has since then changed their name to Union Pacific Railroad Company and ask that the replacement structure stipulated to in 1990 be redesigned to provide greater minimum vertical clearance above the top of rails and the City has developed a new design which will provide greater vertical clearance above the top of rails; and
Whereas, The parties hereto now wish to terminate the stipulation adopted by the Common Council on November 27, 1990 in Resolution File Number 901221 and replace the existing structure in accordance with the provisions of attached new Stipulation; and
Whereas, Additional negotiations have taken place between the Union Pacific Railway System and the WISDOT, acting on behalf of the City of Milwaukee, to negotiate a new stipulation regarding the reconstruction and maintenance of the overpass structure; and
Whereas, The WISDOT has forwarded the new stipulation document to the City of Milwaukee for approval and execution; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the stipulation between the City of Milwaukee, the WISDOT and the Union Pacific Railway System, for the reconstruction and maintenance of the South 13th Street Overpass structure of the Union Pacific Railway System tracks located north of West Oklahoma Avenue is hereby approved, a copy of which is attached to Common Council Resolution File Number 991638 and incorporated in this resolution by reference as though set forth there in full.
