Analysis
This ordinance clarifies various provisions to the city's ambulance certification regulations.  It further provides the following:
 
1.  The health department shall provide, by first class mail, a certificate renewal application to each certified emergency medical services provider prior to August 31.
 
2.  Prior to the common council committee hearing on a new certificate application, the chief of police shall provide a report on the findings of the chief's background investigation of the certificate applicant.  Previously, the police chief was required to provide the committee with a recommendation regarding the issuance of any certificate, new or renewal.
 
3.  Prior to the committee hearing on a new or renewal application, the city attorney shall verify that the applicant for a new or renewal certificate has submitted documentation sufficient to indicate the applicant's compliance with the surety bond or certificate of insurance requirement for certified emergency medical service providers.  
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
 
Part 1.  Section 75-15-1-g of the code is created to read:
 
75-15.  Ambulance Certification Regulations.
 
1.  DEFINITIONS.
 
g.  "Certificate" means a document giving a person, firm, partnership or corporation providing fee-for-service ambulance service within the city permission to be a provider within the city-wide emergency medical service system.
 
Part 2.  Section 75-15-1-i of the code is amended to read:
 
i.  "Committee" means the [[committee designated by the common council as responsible for ambulance service regulations]] >>common council's public safety committee<< .
 
Part 3.  Section 75-15-4-a of the code is repealed and recreated to read:
 
4.  APPLICATION FOR CERTIFICATION AND SERVICE AREA.  
 
a.  An application for a certificate shall be filed with the health department on forms provided by the department and approved by the board.  The board and the committee are authorized to require sufficient information on the application to determine the qualifications of the applicant to engage in the business of providing basic and advance life support system conveyances.  A completed application shall be referred to the board for its review and recommendation to the common council.  The application shall also be referred to the committee for scheduling of the hearing specified in sub. 7.
 
Part 4.  Section 75-15-4-c of the code is repealed and recreated to read:
 
c.  Each certificate shall be issued for one calendar year.  The health department shall provide, by first class mail, a certificate renewal application to each certified provider prior to August 31.  In order for an applicant for an initial or renewal certificate to be eligible for certification for the next calendar year, the initial or renewal certificate application shall be filed with the health department not later than September 30.
 
Part 5.  Section 75-15-6 of the code is repealed and recreated to read:
 
6.  INVESTIGATION.  a.  Police.  Upon receipt of an application for a new certificate, the health department shall refer the application to the chief of police, who shall cause an investigation to be made.  The chief of police shall provide a written report on the findings of this investigation to the committee prior to the committee hearing described in sub. 7.
 
b.  City Attorney.  Upon receipt of an application for a new or renewal certificate, the health department shall refer the application to the city attorney, who shall verify that the applicant has submitted documentation sufficient to indicate the applicant's compliance with the surety bond or certificate of insurance requirement of sub. 11.  The city attorney shall provide a written report on the sufficiency of the bond or insurance documentation to the committee prior to the committee hearing described in sub. 7.
 
Part 6.  Section 75-15-7-a of the code is repealed and recreated to read:
 
7.  HEARING.
 
a.  Upon referral of an application for certification from the health department to the committee, the committee shall schedule a hearing thereon.  Prior to such hearing, the board shall review the application and submit its written recommendation on the application to the committee.
