This resolution confirms the report of the Commissioner of Public Works, as modified by the Common Council Committee, on projects for which Public Hearings have been held. The resolution authorizes the levying of special assessments and directs the installation and construction of said public improvements.
BODY:
Whereas, The Common Council of the City of Milwaukee adopted preliminary resolutions, determining it necessary and in the public interest to construct and levy special assessments for the following improvements:
 
3rd Aldermanic District
 
E. Geneva Pl. - N. Oakland Ave. to N. Bartlett Ave. ST21190171 (871-0797-0) File Number 961351: Widen the roadway to the south from 30 feet to 40 feet: asphalt pavement reconstruction, replace all curb and gutter, replace driveway approaches, sodding and tree removal as necessary, and grading. (Nonassessable Reconstruction Paving Fund -- $60,385; Assessable Reconstruction Paving Fund -- $5,665)

Whereas, The report of the Commissioner of Public Works has been filed with the City Clerk; and
 
Whereas, Notices have been sent to all interested persons and public hearings held; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works' Report, as amended at said Public Hearing, is approved and the properties therein identified are benefitted; and, be it
 
Further Resolved, That said Commissioner of Public Works is authorized and directed to proceed with said work in accordance with said report pursuant to Section 66.60 and any other pertinent sections of the Wisconsin Statutes and in the manner directed by Section 115-42 of the Milwaukee Code of Ordinances; and, be it
 
Further Resolved, That the proper departments take such action as is required of them to assess the abutting or adjacent properties and collect such assessment in the manner directed by Section 115-42 of the Milwaukee Code of Ordinances; and, be it
 
Further Resolved, That the City Comptroller is authorized and directed to transfer such funds which are available for this purpose to the appropriate capital purpose subaccounts; and, be it
 
Further Resolved, That the projects do not involve any parcels of agricultural land which are eligible for deferred special assessments under the provisions of Section 14.30 of the Milwaukee City Charter; and, be it
 
Further Resolved, That upon request of the property owners (tax key numbers 525-0703-9, 525-1333-6, 525-1373-4, 525-1383-9, 525-1392-8, 525-9907-215-2, 525-9910-122-5, 525-9911-3, 525-9912-100-5, 525-9915-5, 525-9916-110-4, 526-0303-1, and 526-0307-3) the special assessments for storm sewer in S. 92nd St. be deferred until application for connection to said storm sewer is made. Cost for deferred charges shall be in accordance with City Charter 12-10; and, be it
 
Further Resolved, That due to Milwaukee County's fast-tracking of this project, that City funds for the City's share of the S. 92nd St. projects are not currently available, but will be included in the City's 2000 budget; and, be it
 
Further Resolved, That the City Engineer is authorized and directed to approve and make periodic payments to Milwaukee County after receipt of invoices from said County, no sooner than January, 2000 as agreed to by Milwaukee County, for the City's share of the costs for said projects: S. 92nd St. ST30884101 (H201N01C): (Nonassessable Fund ST30884101 -- $500,820; Assessable Fund ST30884101 -- $189,300): S. 92nd St. SW17090126 (H201N01C): (Nonassessable New Sewer Fund -- $65,030; Assessable New Sewer Fund -- $6,170); and, be it
 
Further Resolved, That upon the completion of project: S. 92nd St. ST30884101 and a determination of the actual cost, it is understood that if the City of Milwaukee's share is less than the amount previously paid, the difference will be refunded to said City; and, be it
 
Further Resolved, That projects E. Geneva Pl. ST21190171, S. 92nd St. ST30884101 and S. 92nd St. SW17090126 will be billed after January 1, 2001, but not before 12 months after the project contract has been completed.
