Resolution approving an amendment to lease agreement with New Cingular Wireless PCS, LLC for the placement of personal communications services antennas and ancillary equipment at 8814 W. Lisbon Avenue.
Analysis
This resolution amends a lease agreement with New Cingular Wireless PCS, LLC for the placement of personal communications services antennas at the Milwaukee Fire Department facility located at 8814 W. Lisbon Avenue which was authorized by Common Council Resolution File Number 010247 adopted on July 17, 2001, and amended via Common Council Resolution File Number 151313 and 180549.

Whereas, The Common Council adopted Resolution File Number 010247 on July 17, 2001 approving a lease agreement with New Cingular Wireless PCS, LLC for the placement of personal communications services antennas at the Milwaukee Fire Department facility located at 8814 W. Lisbon Avenue (the “Lease”); and
Whereas, The Common Council adopted Resolution File Number 151313 on June 14, 2016 which amended the Lease to reflect a change in facilities; and
Whereas, The Common Council adopted Resolution File Number 180549 on July 31, 2018 which amended the Lease to reflect a change in facilities; and
Whereas, The Department of Administration, working with the City Attorney's Office, has negotiated a third amendment to the Lease; and
Whereas, This third amendment of the lease agreement between the City and New Cingular Wireless PCS, LLC for the placement of personal communications services antennas at the fire station located at 8814 W. Lisbon Avenue, allows New Cingular Wireless PCS, LLC to further upgrade its facilities; and
Whereas, The Lease offers a fair market value to the City, protects other City interests, and is acceptable to all City participants; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Common Council approves and amends the lease agreement, identified as the "Third Amendment to Lease Agreement," between the City of Milwaukee and New Cingular Wireless PCS, LLC for the placement of personal communications services antennas at the fire station located at 8814 W. Lisbon Avenue, a copy of which is attached to this file, and authorizes the proper City officials to enter into this lease amendment on behalf of the City of Milwaukee; and be it
Further Resolved, That the proper City officials, in consultation with the City Attorney's office, are authorized to make non-substantive changes to the lease amendment, without further Common Council action as necessary to achieve the intent of the City's action
