Resolution authorizing the Commissioner of Public Works to execute a utility agreement with the Wisconsin Department of Transportation for work on City Underground Conduit in conjunction with the North South Freeway West Howard Avenue to Valley Bridge Project with a total estimated cost of $8,342 with a City share of $834.
Analysis
This resolution approves the entitled Agreement for Payment for Relocation or Replacement of Municipal Utility Facilities Located on Public Held Land Required by Freeway Construction for the City Underground Conduit System, and authorizes the Commissioner of Public Works and Comptroller to execute the agreement on behalf of the City of Milwaukee.
This agreement relates to utility work on City Underground Conduit facilities necessitated by the rehabilitation of the West Howard Avenue Bridge, West Lincoln Avenue Bridge, West Maple Street Bridge, West Lapham Boulevard Bridge and West Greenfield Avenue Bridge being undertaken by the Wisconsin Department of Transportation in 2014 and 2015. This agreement provides generally for the City to be reimbursed from the State 90 percent of the City inspection costs for all work on city underground conduit facilities necessitated by the freeway rehabilitation project in accord with Wisconsin State Statute 84.295(4m).
This resolution also authorizes the Comptroller to establish accounts as necessary to track the work and to submit invoices to the State of Wisconsin for work undertaken on this project as approved by the Commissioner of Public Works, for a total amount of $8,342 with a City share of $834.
Body
Whereas, The State of Wisconsin Department of Transportation has scheduled the reconstruction of the North South Freeway Bridges over IH-43; and
Whereas, There will be work required on City Underground Conduit facilities as a result of the design and construction associated with the North South Freeway Bridge work; and
Whereas, Wisconsin State Statute 84.295(4m) indicates that the Wisconsin Department of Transportation will pay 90 percent of the cost of alteration, rehabilitation and relocation of municipal utilities with the responsible jurisdiction liable for the remaining 10 percent of the costs for this project; and
Whereas, The estimated costs for inspection of City Conduit System in conjunction with this project will be $8,342 with the City of Milwaukee 10 percent share being $834; and
Whereas, In order for the City of Milwaukee to be reimbursed for the 90 percent share of the conduit inspection cost on the North South Freeway Bridge work, the Wisconsin Department of Transportation requires the entering into Municipal Utility Agreement Number 101 (UA 101), in accord with relocation assistance policy; and
Whereas, The Wisconsin Department of Transportation has provided the City of Milwaukee with the necessary municipal utility agreements to facilitate reimbursement of City costs in the alteration of City Underground Conduit facilities; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works and Comptroller are hereby authorized to execute the Utility Agreement (UA 101) for City Underground Conduit, attached to this resolution by reference as though set forth in full; and, be it
Further Resolved, That the Commissioner of Public Works is hereby authorized to provide construction inspection services and is authorized to allow Wisconsin Department of Transportation to include City Underground Conduit work in the North South Freeway work contract for City Underground Conduit work associated with the North south Freeway project and, be it
Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Improvements Fund, Grant and Aid Projects, the necessary project grant chartfield values for construction inspection for the project expenditure and transfer to any of these accounts the amounts required under the grant agreement and City accounting policy but not to exceed a 10 percent increase of the total amounts reserved for the grantors share and local share of $5,000, whichever is greater, as follows:
