Title

Resolution declaring the tax-deed vacant lot at 2944 West Hampton Avenue surplus to municipal needs and authorizing acquisition by the Milwaukee Metropolitan Sewerage District for the North 27th Street Inline Storage System Extension Project, in the 1st Aldermanic District.

Analysis

This resolution will permit the City of Milwaukee to convey property to the Milwaukee Metropolitan Sewerage District for a special purpose pursuant to Section 304-49-2 and 304-49-3, Milwaukee Code of Ordinances.

Body

Whereas, The Milwaukee Metropolitan Sewerage District (“MMSD”) is conducting the North 27th Street Inline Storage System Extension Project, formerly known as the Port Washington Road Relief Sewer, and needs to acquire the City-owned vacant lot at 2944 West Hampton Avenue for the project; and

 

Whereas, MMSD provided the City of Milwaukee (“City”) with an independent appraisal and has offered to acquire the property pursuant to Chapter 32.05, Wisconsin Statues; and

 

Whereas, MMSD and Department of City Development (“DCD”) Staff have negotiated a purchase price of $7,000, which DCD believes represents fair market value for the property; and

 

Whereas, Section 304-49-2 and 304-49-3 allows the City to convey property to public and quasi-public entities for a special purpose, such as MMSD’s sewer project, upon approval of the Common Council; and

 

Whereas, The City Plan Commission has determined that the property is surplus to municipal needs; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the property at 2944 West Hampton Avenue is declared surplus to municipal needs and that the offer to purchase submitted by MMSD for the property is accepted; and, be it

 

Further Resolved, That the Commissioner of DCD is authorized to execute the offer to purchase, the deed of conveyance and other documents necessary to carry out the intent of this resolution; and, be it

 

Further Resolved, That the sale proceeds, less acquisition expenses and a 25 percent disposition cost reimbursement to the Redevelopment Authority of the City of Milwaukee, shall be paid to the Reserve For Tax Deficit Fund, Account No. 0001-334106.
