This resolution authorizes the transfer of funds from the Outside Counsel/Expert Witness Fund to the City Attorney's Office for an arbitration proceeding between the Board of Harbor Commissioners of the City of Milwaukee and Specialty Restaurants, Inc.
Body
Whereas, The City Attorney's Office requests that funds be transferred to the City Attorney's Office for an arbitration proceeding between the Board of Harbor Commissioners of the City of Milwaukee and Specialty Restaurants, Inc.; and
Whereas, The latter proceeding involves arbitration of a dispute between the Board of Harbor Commissioners and Specialty Restaurants, Inc. over the base rent to be charged to Specialty Restaurants, Inc. as operator/manager of the Pieces of Eight restaurant (550 North Harbor Drive) for the period February 1, 1998 through January 31, 2008; and
Whereas, This case involves a number of appraisal issues associated with the value of the land upon which the Pieces of Eight restaurant is situated, a unique parcel of lakefront real estate; and
Whereas, The City has engaged Jeffrey G. Pyzyk, MAI, President of Appraisal Resource Group, Inc. to provide expert assistance and testimony in this proceeding, particularly with respect to these appraisal and valuation issues; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that $15,000.00 be transferred from the Outside Counsel/Expert Witness Fund No. 0001 9990 0001 S157 2003 006300 to the City Attorney's Office Fund No. 0001 1490 0001 S157 2003 006300 for the above-described proceeding; and, be it
Further Resolved, That the proper city officers be and are hereby authorized and directed to make whatever fund transfers are necessary and appropriate to carry out the provision of this resolution and that the application of the funds directed herein to a case other than that specifically referred to herein shall be subject to the further direction of the Common Council; and, be it
Further Resolved, That the Office of the City Attorney is hereby authorized and directed to engage the services of experts and pay other litigation expenses related to the above-referenced matter.
