Resolution authorizing the Commissioner of Public Works and Comptroller to execute four Project Agreements with the Wisconsin Department of Transportation for traffic signal improvements and to fund preliminary engineering for these four projects using Congestion Mitigation Air Quality program funds in various Aldermanic Districts with a total estimated preliminary engineering cost for these four projects of $601,500, with a grantor share of $481,200 and a City share of $120,300.
Analysis
Resolution authorizing the Commissioner of Public Works and Comptroller to execute four Project Agreements with the Wisconsin Department of Transportation for traffic signal improvements and to fund preliminary engineering for these four projects using Congestion Mitigation Air Quality program funds in various Aldermanic Districts. The total estimated cost of the projects is $5,081,500 with a grantor share of $4,065,200, and a City share of $1,016,300. The total estimated preliminary engineering cost for these four projects is $601,500, with a grantor share of $481,200 and a City share of $120,300. Approval of construction costs will be in a future resolution.
Body
Whereas, Preliminary approval has been requested and received from the Wisconsin Department of Transportation, along with four Project Agreements to be executed by the City of Milwaukee, for the programming and construction of four traffic signal improvement projects under the 2015 Congestion Mitigation Air Quality program; and
Whereas, The four approved projects will replace obsolete traffic signal controllers and upgrade communications at 297 signalized intersections Citywide as shown in the attached map; and
Whereas, Funding for ATC Controller and Communication Upgrade Grant #3 was not approved by the Wisconsin Department of Transportation; and
Whereas, The Wisconsin Department of Transportation has submitted four Project Agreements for execution by the City of Milwaukee for the design and construction of:

Whereas, The State cannot proceed with any project cost overruns and changes in scope of more than 5% without prior Department of Public Works approval; and
Whereas, The Department of Public Works shall notify the Common Council of the City of Milwaukee at the next scheduled meeting of any such project cost overruns and changes in scope approved by the Department of Public Works; and
Whereas, The Common Council of the City of Milwaukee recognizes that the City may be 100% liable for any such project cost overruns and changes in scope as approved by the Department of Public Works; and
Whereas, The Common Council of the City of Milwaukee recognizes that the City may be liable for any costs incurred by the State should the City decide to withdraw from the project; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works and the Comptroller are authorized to execute four Project Agreements for the programming, design, and construction of aforementioned projects with Congestion Mitigation Air Quality program funds, copies of which are attached to and incorporated in this resolution by reference as though set forth in full; and, be it
Further Resolved, That the proper City of Milwaukee official is hereby directed to undertake preliminary engineering for the above-mentioned projects, which is anticipated to begin in 2015, and to reimburse the Wisconsin Department of Transportation for preliminary engineering costs they incur for the improvements; and, be it
Further Resolved, That Department of Public Works shall request in a future resolution funding for the construction phases of the three projects; and, be it
Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Improvement Fund, Grant and Aid Projects, the necessary Project Grant Chartfield Values for preliminary engineering for the project (expenditure) and transfer to any of these accounts the amount required under this grant agreement and City Accounting policy, but not to exceed a 10 percent increase of the total amounts reserved for the grantor's share and the local share or $5,000, whichever is greater as follows:
