The purpose of this resolution is to initiate a vacation proceeding under power granted to the City by Sec. 66.297(1), Wis. Stats.
 
 
BODY:
Whereas, It is proposed that the unimproved pedestrian walkway between the properties located at 3776 North 98th Street and 3784 North 98th Street be vacated pursuant to the provisions of Section 66.297 of the Wisconsin Statutes; now, therefore, be it
 
Resolved by the Common Council of the City of Milwaukee, as follows:
 
1. That the City Engineer be and hereby is authorized and directed to prepare a map and legal description showing the portion of pedestrian walkway to be vacated and the property ownership abutting thereon and forward the same to the City Plan Commission and the City Attorney's office for further action;
 
2. That the City Attorney's office be and hereby is authorized and directed to commence circulation of the usual coordinated report appropriate in pedestrian walkway vacations to the various departments and that when the same is completed it be forwarded to the City Plan Commission;
 
3. That in such coordinated report each department estimate and set forth any charges or costs that will be incurred by the City of Milwaukee as a result of pedestrian walkway vacations;
 
4. That the City Attorney be and hereby is authorized and directed to prepare and file the necessary notice of Lis Pendens as required under the laws of the State of Wisconsin;
 
5. That the City Engineer is and he is hereby authorized to obtain, an abstract or ownership record of the properties abutting the pedestrian walkway proposed to be vacated; and forward one copy of such to the City Attorney's office for preparing the necessary Lis Pendens;
 
6. That the Manager of Real Estate in the Department of City Development be and hereby is authorized and directed to estimate the damages and benefits to the properties abutting on the pedestrian walkway proposed to be vacated and submit his report to the City Plan Commission;
 
7. That the City Plan Commission in the Department of City Development be and hereby is authorized and directed that when all the above information has been assembled to prepare a report and recommendation thereon and forward the same to the Public Improvements Committee of the Common Council for further action;
 
and, be it
 
Further Resolved, That upon receipt of the report and recommendation of the City Plan Commission, the Public Improvements Committee of the Common Council may schedule a public hearing at such time and upon such notice as is required under the provisions of Section 66.297(2), Wisconsin Statutes, and may after such public hearing make further recommendation to the Common Council.
