This resolution gives permission to Milwaukee Metropolitan Sewerage District to either attach telemetry antennae to City light poles or install their own poles with antenna both including the installation of any necessary conduit and/or cabling as a part of their Conveyance Supervisory Control and Data Acquisition Project.
Body
Whereas, Milwaukee Metropolitan Sewerage District (MMSD) has planned, designed, constructed, established, maintained, and operated a sewerage system for the collection, transmission and disposal of all sewerage and drainage of the sewerage service area, including the collection, transmission and disposal of storm water and groundwater; and
 
Whereas, MMSD has constructed and established its sewerage system, in part, on, under, and through various public rights-of-way and real estate owned by the City of Milwaukee; and
 
Whereas, MMSD has ascertained that establishment of a system of directional radio antenna facilities will allow MMSD to improve its ability to effectively and efficiently control its system and monitor flows within that system; and
 
Whereas, MMSD has proposed to locate the sites for each antenna in proximity to the telemetry boxes to be controlled thereby, consistent with avoidance of loss of signal, for the maximum benefit to the public; and
 
Whereas, These above-ground boxes are predominantly located either within the street "tree border" or street median; and
 
Whereas, The decision on where to place an antenna is dependent upon the ability of the antenna to direct radio waves to a repeater antennae established on the Ameritech Tower at the City of Greenfield's Municipal Building, Sandburg Hall Dormitory at the University of Wisconsin-Milwaukee, the Milwaukee Hilton (in downtown Milwaukee), and the American Tower Corporation tower on North Humboldt, north of West Capitol Drive; and
 
Whereas, It is not possible in many instances to attach the antenna directly to the box; and
 
Whereas, MMSD proposes to attach the antenna either to:  City street light poles, WE Energies poles or their own small diameter poles; and
 
Whereas, Any antenna attached to City street light poles or MMSD's new poles in the right-of-way legally requires by the granting of permission by the Common Council; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby authorized to issue all necessary permits for: 1) attachment of the telemetry antennae to City light poles; 2) installation of their small-diameter poles with antenna in the vicinity of the telemetry boxes; and 3) installation of any necessary conduit and/or cabling extending from the box to the pole of:
 
a) those locations presently proposed and as shown on a list attached to this file, as incorporated therein,
 
b) those locations that may, in the future, require similar attachments and/or poles
 
; and, be it
 
Further Resolved, That this permission is granted only on the conditions that the MMSD shall:
 
1.  Hold the City of Milwaukee or its agents harmless and accept responsibility for any and all liabilities that may arise through implementations of the permission granted herein.
 
2.  Obtain the necessary Department of Public Works permit prior to installation of the conduits and any other related items within the right-of-way.
 
3.  Install the antennae as shown on the plan with "as-built" plans submitted to the City Engineer, in a timely manner,  to show the actual installation, including all necessary pertinent locational dimensions.
 
4.  Whenever antennae or poles are no longer needed or when so ordered for public necessity, not only remove these items but shall also restore to its former condition and to the approval of the Commissioner of Public Works any public improvement which was removed, changed or disturbed by reason of the granting of this resolution.  Grantee shall not be entitled to any damages for such removal.
