Analysis

This resolution rescinds a special privilege granted Melanec’s Wheelhouse Incorporated for a free standing advertising sign and orders the removal of said sign, which is located in the public right-of-way of North Humboldt Avenue abutting a neighboring property.

Body

Whereas, Melanec’s Wheelhouse Incorporated, owner of the property at 2178 North Riverboat Road, petitioned for permission for a free standing advertising sign located in the public right-of-way adjacent to a neighboring property, 2060 North Humboldt Avenue; and

Whereas, The owner of the property at 2060 North Humboldt Avenue indicated by letter that there was no objection to the placement of said sign in front the property at that time; and

Whereas, Permission for said free standing advertising sign was granted under Common Council Resolution File Number 82-1055 in 1982; and

Whereas, Said sign will necessarily be removed from the public right-of-way as part of the North Humboldt Avenue Bridge over the Milwaukee River bridge replacement project in 2007; and

Whereas, The current owner of the property at 2060 North Humboldt Avenue, Willow Tree Development LLC, which is in the process of constructing a new facility, objects to the sign; and

Whereas, Section 245-12-3(d) of the Milwaukee Code of Ordinances requires that a special privilege grantee remove such special privilege, at its own expense, when so ordered by resolution adopted by the Common Council; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that Common Council Resolution File Number 82-1055 is hereby rescinded; and, be it

Further Resolved, That the Commissioner of Public Works be and hereby is authorized and directed to order Melanec’s Wheelhouse Incorporated to remove said free standing advertising sign from the public right-of-way within thirty (30) days; and, be it

Further Resolved, That upon failure of the owner to remove said free standing advertising sign within said thirty (30) day period, the Commissioner of Public Works is hereby authorized and directed to remove the same and assess the cost thereof against the owners of the property at 2178 North Riverboat Road.
