Analysis
This ordinance increases various food license, precious metal and gem dealer, secondhand dealer, and public passenger vehicle fees.  This ordinance takes effect March 16, 2012.
Body
 
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
 
Part 1.  Section 60-21-7 of the code is repealed and recreated to read:
 
60-21.  Food Dealer's License.
7.  License renewals shall be filed by the deadline established by the city clerk.  There shall be an additional fee for the filing of a late renewal application in the amount of $75.  Late renewal applications filed 10 days or less before their expiration shall be assessed an additional fee of $125.
 
Part 2.  Section 60-21-10 of the code is created to read:
 
10.  The fee for a licensed food establishment that extends its operation to the outside on a permanent basis shall be $50.  Locations filing for alcohol beverage extensions under s. 81-90 at the same time shall be charged a total fee of $75.
 
Part 3.  Section 60-23-3-d of the code is repealed and recreated to read:
 
60-23.  Temporary Food Dealer's License.
3.  FEES.
d.  Temporary extension.  The following fees shall apply to a licensed food establishment that extends its operation to the outside on a temporary basis:
d-1.  $50, if the application is filed on or before the filing deadline established by the city clerk.
d-2.  $100, if the application is filed after the filing deadline established by the city clerk.
 
Part 4.  Section 60-23-4 of the code is repealed and recreated to read:
 
4.  Failure to pay and be issued a permit to operate a temporary event prior to the event occurring shall result in the applicant not being allowed to participate in the event.  No application may be made at the event or accepted after the event regardless of whether the event occurs during hours of city operation or not.  Any applicant who has failed to pay for a previous temporary event and has not withdrawn the application prior to the previous event, shall pay for an outstanding fee prior to any other temporary event application being accepted.
 
Part 5.  Section 60-23-5 of the code is amended to read:
 
5.  LATE FEE.  Any person who does not meet the application deadline in sub. 4 shall pay a late application fee of [[$54]] >>$75<< for each individual food operation, site, location or stand where food is prepared, served or sold at the temporary event.  >>Any person meeting the application deadline for a temporary food dealer's license shall pay the fee for the temporary food dealer's license within 10 days of application or be assessed a late fee of $75.<<
 
Part 6.  Section 60-31-4 of the code is repealed and recreated to read:
 
60-31.  Food Peddler Permit.
4.  Permit renewals shall be filed by the date established by the city clerk.  There shall be an additional fee for the filing of a late renewal application in the amount of $75.  Late renewal applications filed 10 days or less before their expiration shall be assessed an additional fee of $125.
 
Part 7.  Section 60-48-3 of the code is amended to read:
 
60-48.  Ice Cream Peddler License.
3.  The fee for a duplicate license is [[$9]] >>$11<<.  
 
Part 8.  Section 60-48-4 of the code is created to read:
 
4.  License renewals shall be filed by the deadline established by the city clerk.  There shall be an additional fee of $25 for the filing of a late renewal application.  Late renewal applications filed 10 days or less before their expiration shall be assessed an additional fee in the amount of $50.<<
 
Part 9.  Section 81-1-4 of the code is amended to read:
 
81-1.  General Provisions.
4.  DUPLICATE LICENSE OR PERMIT FEE.  Except where otherwise provided, the fee for a duplicate copy of any license of permit issued through the city clerk's office shall be [[$10]] >>$11<<.
 
Part 10.  Section 81-90 of the code is amended to read:
 
81-90.  Permanent Extension of Alcohol Beverage Licensed Premises.  The fee for a permanent extension of alcohol beverage licensed premises shall be $50.  >>Locations filing for the extension of operations to the outside on a permanent basis under s. 60-21-10 shall be charged a total fee of $75.<<
 
Part 11.  Section 81-99.5-2 of the code is amended to read:
 
81-99.5.  Precious Metal and Gem Dealer's License.
2.  The fee for each license shall be [[$125]] >>$150<<.
 
Part 12.  Section 81-101.3 of the code is amended to read:
 
81-101.3.  Public Passenger Vehicle Permit Fee, Special.  The fee for any special inspection of a public passenger vehicle, as provided in s. 100-51, shall be [[$100]] >>$125<<.
 
Part 13.  Section 81-104-2 of the code is amended to read:
 
81-104.  Secondhand Dealer's License.
2.  The fee for each license shall be [[$125]] >>$150<<.
 
Part 14.  Section 81-131.5 of the code is amended to read:
 
81-131.5.  Vehicle Replacement Fee.  The fee for each public passenger vehicle transfer shall be [[$100]] >>$125<<.
 
Part 15.  This ordinance takes effect March 16, 2012.
