Analysis

Current code provides criteria that must be met for the police department to accept grant funds for the provision of additional law enforcement services.  The code allows for acceptance from tax-exempt public or quasi-public entities that own or operate large venues open to the public that occasion additional police services in areas adjacent to the venue.  Law enforcement grants may also be accepted by entities that own or operate facilities that present unique security needs or licensed alcohol beverage establishments.  

 

This ordinance expands current criteria to allow for acceptance of grant funds for additional law enforcement services from 501(c)(3) corporations seeking to enhance public safety through community crime intervention initiatives.

  

Body

Whereas, Common Council Resolution File Number 011573, adopted April 23, 2002, established a policy for acceptance of grant funds from tax-exempt public or quasi-public entities that own and operate large venues open to the public which often require additional law enforcement services in order to meet the needs of public safety and convenience, thereby relieving the general city property tax-payers from funding the cost of these additional law enforcement services and providing the framework for agreements with the Bradley Center Sports and Entertainment Corporation, the Milwaukee Brewers Baseball Club and the Milwaukee Public Schools; and

 

Whereas, Common Council Resolution File Number 021317, adopted March 25, 2003, amended this policy to allow acceptance of grant funds for such additional police services in areas of the City adjacent to qualifying public venues, allowing for such an agreement with the University of Wisconsin-Milwaukee; and

 

Whereas, Common Council Resolution File Number 040746, adopted November 3, 2004, further amended this policy to include commercial entities that present unique security needs on or around their premises, providing requisite authority for a law enforcement special assignment grant agreement with the West Shore Pipe Line Company; and

 

Whereas, The aforementioned criteria for acceptance of grant funds for additional law enforcement services were later codified, effective December 12, 2007, in s. 304-83 of the Code of Ordinances, with this ordinance also allowing for acceptance of law enforcement grant funds - in the interests of enhanced public safety - from alcohol beverage establishments licensed by the city; and

 

Whereas, The Common Council believes it is in the public interest to further amend the code to allow for acceptance of law enforcement grant funds from 501(c)(3) corporations for community crime intervention initiatives that seek to enhance public safety and convenience, with individual grant monies funding specific law enforcement services delineated in an agreement between the police department and the corporation; now, therefore 

 

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1.  Section 304-83-2-b-0 of the code is amended to read:

 

304-83.  Additional Grants for Law Enforcement Services.

2.  CRITERIA

b.  In lieu of the criteria specified in par. a, grants may also be received from entities that meet [[either]]>>one<< of the following criteria:

 

Part 2.  Section 304-83-2-b-3 of the code is created to read:

 

b-3.  The entity is a 501(c)(3) corporation seeking to enhance public safety through a community crime intervention initiative.
