Title
Substitute resolution to vacate the right-turn bypass at the Northeast Corner of East Seeboth Street and South 1st Street, in the 12th Aldermanic District.
Analysis
This substitute resolution vacates the above right-turn bypass in accordance with vacation proceedings under power granted to the City of Milwaukee by Section 66.297(1), Wisconsin Statutes, and Section 81-308-28, Milwaukee Code of Ordinances. This vacation was requested by Renner Architects, LLC, to consolidate land for the Waterfront residential project.

Whereas, It is proposed that the right-turn bypass at the Northeast Corner of East Seeboth Street and South 1st Street be vacated pursuant to the provisions of Section 66.297, Wisconsin Statutes; and
Whereas, The Department of Public Works has been authorized and directed to prepare a coordinated report estimating all costs and benefit assessments that will be incurred with said vacation; and
Whereas, Said vacation has been reviewed in accordance with Section 81-308-28, Milwaukee Code of Ordinances; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that said right-turn bypass as indicated by Exhibit A and bound and described by:
That part of the Northeast 1/4 of Section 32, Township 7 North, Range 22 East, described as follows: Commencing at the Southeast Corner of Lot 10 in Block 1 of Walkers Point, a recorded subdivision in said 1/4 Section; thence South 89 deg. 21 min. 14 sec. West, along the north line of East Seeboth Street, 23.00 feet to its point of intersection with the present easterly line of South 1st Street and the point of beginning of the land to be described; thence South 69 deg. 29 min. 55 sec. West 19.14 feet to a point lying 6.50 feet South of, as measured normal to, the westerly extension of said north line; thence South 89 deg. 21 min. 14 sec. West, parallel to said westerly extension, 20.27 feet to a point of curve; thence Northwesterly 22.68 feet along the arc of said curve which has a radius of 11.00 feet with its center lying to the Northeast having a central angle of 118 deg. 06 min. 30 sec. and whose chord bears North 31 deg. 35 min. 31 sec. West 18.87 feet to a point of tangency; thence North 27 deg. 27 min. 44 sec. East 98.90 feet to a point in the present easterly line of South 1st Street; thence South 01 deg. 27 min. 41 sec. East, along said present easterly line, 96.93 feet to the point of beginning is vacated; and, be it
Further Resolved, That upon deposit of the funds required, the Commissioner of Public Works and/or the City Engineer are authorized to implement actions listed in the coordinated report relating to said vacation; and, be it
Further Resolved, That as provided by Section 80.32(4), Wisconsin Statutes, said vacation shall not terminate the easements and rights incidental thereto acquired by or belonging to any county, town, village or city, or to any utility or person in any underground structures, improvements or services, as enumerated or otherwise existing in said description of land above described, both easements and rights and all rights of entrance, maintenance, construction and repair with reference thereto shall continue as if said right-turn bypass had not been vacated.
