Title
Substitute resolution approving construction of nonassessable public improvements at various locations and appropriating funds for these purposes with the City construction cost estimated to be $20,910,000 for a total estimated cost of these projects being $21,811,000 of which $16,263,000 is for projects that have been submitted to the Wisconsin Department of Natural Resources for consideration for American Recovery and Reinvestment Act (ARRA) funding.
Analysis
This resolution directs the installation and construction of certain public improvements which have been determined to be nonassessable by the Commissioner of Public Works. The City cost of the projects approved by this resolution is estimated to be $20,910,000. The total estimated cost of these projects is $21,811,000.
Projects totaling $16,263,000 million in this file include 2010 sewer projects that have been accelerated to qualify for the WDNR Clean Water Fund program as part of the American Recovery and Reinvestment Act (ARRA) stimulus program. To qualify for funding, ARRA projects must be under contract by October 1st, 2009. In order to place projects under contract by October 1st, projects need both Public Works Committee construction approval and budget authority. This file achieves the former. Council file 090330, if amended, will include up to $16.3 million in contingent borrowing authority. This will allow the Comptroller's Office to certify funding for these projects ahead of the WDNR's decision to award the Clean Water Funding. The 2010 Sewer Maintenance Fund capital budget will be reduced to reflect projects funded with 2009 contingent borrowing authority.

Whereas, The Common Council of the City of Milwaukee adopted preliminary resolutions determining it necessary and in the public interest to construct nonassessable improvements; and
Whereas, Common Council file 081478 directed the appropriate City of Milwaukee officials and City departments to apply for economic stimulus funds for qualifying City projects in accordance with the federal American Recovery and Reinvestment Act (ARRA); and
Whereas, The Department of Public works applied for sewer project funding from the Clean Water Fund, administered by the Wisconsin Department of Natural Resources; and
Whereas, The available 2009 Clean Water Fund appropriations were greatly increased due to ARRA funding; and
Whereas, The Clean Water Funds will be awarded as a combination of low-interest loans and grants; and
Whereas, As a condition to receive ARRA funding, construction projects must be bid and under contract with a vendor by October 1st, 2009; and
Whereas, $16,263,000 of these projects do not have existing budget authority currently available to the Department of Public Works for construction; and
Whereas, Contingent borrowing authority may be necessary for the Comptroller’s Office to certify available funds for the projects ahead of the ARRA awards; and
Whereas, Council file 090330, if amended, will include up to $16.3 million in contingent borrowing authority; and
Whereas, Existing sewer capital accounts have $8,735,000 in appropriation authority that the Comptroller’s Office has assigned to department 9990 in the event that the sewer projects are funded through revenue bonds requiring a reserve; and
Whereas, The full $8,735,000 may not be needed if Clean Water Fund low-interest loans and grants are used to fund capital projects; and
Whereas, The amount of contingent borrowing may be reduced at the Comptroller’s discretion by assigning existing sewer capital budget authority assigned to department 9990 to the Department of Public Works to fund project construction; and
Whereas, The 2010 Sewer capital program will be reduced to reflect projects funded through contingent borrowing; and
Whereas, Plans, specifications and cost estimates have been prepared for the following described improvements:
