Resolution authorizing City execution of an Intergovernmental Cooperation Agreement between the City of Milwaukee and the Milwaukee Metropolitan Sewerage District for the purposes of establishing maintenance responsibilities for the North 35th Street and West Roosevelt Drive Sewer Improvements.

Analysis

This resolution authorizes City execution of an Intergovernmental Cooperation Agreement between the City of Milwaukee and the Milwaukee Metropolitan Sewerage District for the purposes of establishing maintenance responsibilities for the North 35th Street and West Roosevelt Drive Sewer Improvements.

Body

Whereas, Flooding has been reoccurring in the area around the North 30th Street Corridor between West Townsend Street and West Hampton Avenue located within the Lincoln Creek watershed; and

 

Whereas, The July 2010 rain event caused damages exceeding $32 million and in extreme wet weather events, such flood damages are likely to continue to occur without improvements to the Milwaukee Metropolitan District‘s (District) and City of Milwaukee’s (City) infrastructure serving the North 30th Street Corridor; and

 

Whereas, The City and the District have been making substantial investments to reduce the risk of flooding along Lincoln Creek north of the North 30th Street Corridor; and

 

Whereas, In 2020, the District evaluated bypass pumping station BS0503, which pumps excess sanitary sewer flow in times of tremendous exertion on the conveyance system into a City stormwater box culvert that in turn discharges into the Lincoln Creek at West Congress Street, and

 

Whereas, The District has designed and The North 35th Street and West Roosevelt Drive Improvements project (the “Project”) which is intended to alleviate the flooding; and

 

Whereas, The District executed a contract for the construction of the Project on September 25, 2023, as authorized by Milwaukee Metropolitan Sewerage Commission resolution 23-110-9 and is overseeing construction. The Project includes constructing and installing 17 City precast concrete manholes and segments of local small-diameter sanitary sewer. The District is paying all construction costs; and

 

Whereas, The District’s responsibilities and the City’s responsibilities are detailed in the Agreement, a copy of which is attached to this file; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Intergovernmental Cooperation

Agreement between the City of Milwaukee and the Milwaukee Metropolitan Sewerage District for the purposes of establishing maintenance responsibilities for the North 35th Street and West Roosevelt Drive Sewer Improvements, is approved as attached to this file, or one in substantially the same form and substance as submitted; and, be it

 

Further Resolved, That the appropriate City officers and employees, including the Commissioner of Public Works, are hereby authorized to sign the Agreement, or one in substantially the same form and substance as submitted, and to undertake such acts as are required of the City thereunder or in furtherance thereof, to effectuate the Agreement and this resolution, including signing of deeds and easements contemplated and required by the Agreement; and, be it

 

Further Resolved, That any expenditure of City funds that may be necessary as a result of the City signing the Agreement will be brought forth for Common Council consideration and approval.
