Resolution authorizing and directing the Commissioner of Public Works to execute an Intergovernmental Cooperation Agreement with the Milwaukee Metropolitan Sewerage District regarding the removal of the Lower Hawley Road Bridge over the Menomonee River. (Infrastructure Services Division)
Analysis
This resolution authorizes and directs the Commissioner of Public Works to enter into an agreement with the Milwaukee Metropolitan Sewerage District that spells out each party's responsibilities with respect to the removal of the Lower Hawley Road Bridge over the Menomonee River.
Body
Whereas, The Milwaukee Metropolitan Sewerage District (District) has jurisdiction over the Menomonee River within Milwaukee County for the purpose of projecting, planning, designing, and constructing improvements to the Menomonee River; and
 
Whereas, The District has developed and is implementing a plan for a flood management project in the vicinity of Hart Park in the City of Wauwatosa to eliminate or reduce flood damage to downtown Wauwatosa and related properties, known as the Menomonee River Flood Management Project (Project); and
 
Whereas, During the preliminary engineering phase of the Project, the District ascertained that the Lower Hawley Road Bridge over the Menomonee River is hydraulically inadequate to permit flows from the 1% probability flood to pass; and
 
Whereas, The District has agreed to pay all of the costs associated with the demolition of the Lower Hawley Road Bridge; and
 
Whereas, The District has agreed to cooperate with the City in the relocation of two communication bundles and a sanitary sewer currently attached to the Lower Hawley Road Bridge, and for protection of water mains and other City facilities in the vicinity of the bridge during demolition; and
 
Whereas, The agreement attached to the file addresses the City's concerns regarding City-owned facilities affected by the bridge demolition; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that, in light of the above declarations, and contingent on a favorable review by the City Attorney with respect to form, the Commissioner of Public Works is hereby authorized and directed to execute an Intergovernmental Cooperation Agreement with the Milwaukee Metropolitan Sewerage District, setting forth the respective roles of the City and District in the removal of the Lower Hawley Road Bridge; and, be it
 
Further Resolved, That non-substantive changes can be made to the agreement prior to execution; and, be it
 
Further Resolved, That the Commissioner of Public Works is authorized and directed to enter into a subsequent agreement concerning the relocation of the City's communication facilities as may be necessary to allow for the removal of the bridge while protecting the integrity of the City's communication system at no cost to the City; and, be it
 
Further Resolved, That the Commissioner of Public Works is authorized to issue permits to close North Hawley Road in the vicinity of the Lower Hawley Road Bridge and to remove the bridge; and, be it
 
Further Resolved, That the Department of Public Works is hereby authorized to accept an engineering deposit and to begin designing the sanitary sewer relocation.
